would be applicable are contributing suspended solids to streamflow or runoff outside the permit area <br /> in excess of pre-mining levels as determined by baseline data or in excess of levels determined on <br /> adjacent non-mined areas." <br /> Phase III Bond Release <br /> The Division's Guideline Regarding Selected Coal Mine Bond Release Issues dated April 18, 1995 <br /> outlines what the Division may use to evaluate reclaimed lands proposed for Phase III bond release. <br /> In summary,the Division shall evaluate the following: <br /> Rule 3.03.1(2)(c) states that: <br /> the final portion of performance bond "shall be released when the permittee has successfully <br /> completed all surface coal mining reclamation operations in accordance with this approved <br /> reclamation plan,and the final inspection procedures of 3.03.2 have been satisfied. This shall not <br /> be before the expiration of the period specified for revegetation responsibility in 3.02.3." <br /> Rule 3.03.1(4) states: <br /> "No bond shall be fully released until all reclamation requirements of these Rules and the Act are <br /> fully met... The same rule goes on to state that: <br /> "No acreage shall be released from the permit area until all surface coal mining and reclamation <br /> operations on that acreage have been completed in accordance with the approved reclamation <br /> plan." <br /> Permit Requirements Success Standards <br /> Phase I Bond Release <br /> The approved reclamation plan for the Williams Fork Mines calls for backfilling and grading to establish <br /> a stable configuration blending with the surrounding terrain and includes the reestablishment of effective <br /> drainage. Backfilling and grading is accomplished using overburden and interburden material from a <br /> cut to backfill a previous, adjacent cut. Once backfiilled, disturbed areas are rough graded with <br /> bulldozers and/or graders shaping the area as per the Reclamation Plan Map(Map 2913,Exhibit 24D), <br /> to resemble the approximate configuration of pre mining conditions. Upon completion of backfilling <br /> and grading, soil and topsoil are redistributed by scrapers and spread by dozers or graders,providing an <br /> appropriate plant growth medium. Reclaimed area slope profiles are illustrated on Maps E24C and E <br /> 24B of the Reclamation Plan. Representative cross sections, final topography and associated <br /> reclamation plans for the Strip Pit are illustrated in Exhibit 24 of the permit Lastly, seeding <br /> appropriate to the permitted land use occurs. <br /> Specific reclamation plans,exhibits and maps relevant to the SL4 permitting action comprise: <br /> o Strip Pit Reclamation Plan(Permit Exhibit 24) <br /> o Standards for the pre law area(Permit Exhibit 24). <br /> o Map 20 Strip Pit Reference Area B and baseline sampling area. <br /> o Technical Standards for the Utah Tract(PAP section 2.05.4 and Exhibit 14a)and Section 4.4 of the <br /> Trapper permit document. <br /> o Exhibit 14 supplemental vegetation information. <br /> Permit Number C1981044 Page 9 of 25 <br />
