Vegetation cover of the reclaimed area will be successful when total live vegetation cover of the <br />reclaimed areas is equal to or greater than 90 percent of the total herbaceous vegetation cover of <br />the approved extended reference area with 90 percent statistical confidence <br />Group 3 (Bear Creek Fansite (leased to Vessels)) <br />This site has been approved for a post -mining land use of "Industrial/Commercial". There is no <br />revegetation standard. Erosion is minimized and controlled by in -place best management <br />practices. <br />PHASE III <br />Rule 3.03.1(2)(c) states that the final portion of performance bond, "shall be released when the permittee <br />has successfully completed all surface coal mining reclamation operations in accordance with this <br />approved reclamation plan, and the final inspection procedures of 3.03.2 have been satisfied. This shall <br />not be before the expiration of the period specified for revegetation responsibility in 3.02.3." Rule <br />3.03.1(4) states, " No bond shall be fully released until all reclamation requirements of these Rules and <br />the Act are fully met...". The same rule goes on to state, " No acreage shall be released from the permit <br />area until all surface coal mining and reclamation operations on that acreage have been completed in <br />accordance with the approved reclamation plan." <br />The only site for which phase III release has been requested with SL-2 is the Bear Creek Fansite (leased <br />to Vessels), which has been approved for a post -mining land use of "Industrial/Commercial". Specific <br />requirements are detailed above. <br />III. OBSERVATIONS AND FINDINGS <br />PHASE I <br />Group 1 (Bear Creek B-Seam Portal & Fansite (US Steel), Lower Hubbard Creek facilities area, <br />Hubbard Creek Fan 91 Site) <br />Reclamation of the Bear Creek B-Seam Portal & Fansite (US Steel) and the Lower Hubbard <br />Creek facilities area took place many years before the SL-2 application was submitted. A <br />complete description of the reclamation activities completed, with timings, was added to section <br />2.05.4 of the PAP. The text is provided in Section II of these Findings. It states that the <br />reclamation of both sites was completed in 1996. <br />Reclamation of the Hubbard Creek Fan 91 Site was completed more recently (2011), but well <br />before the submission of the SL-2 application. Reclamation progress was documented in the <br />reports of inspections that occurred on July 15, 2009 (backfilling of the vent shaft); June 23, <br />2010 (shaft capping and sealing); December 17, 2010 (structure demolition); and May 25, 2011 <br />C-1981-022, SL-2 Page 17 of 23 <br />
