GW-N3 is located north of the permit area in Section 36 in an area that was previously <br />mined by Peabody Energy, predecessors to ERMR. It is unclear from the permit why this well continues to be <br />monitored. GW-N3 was located and appears to be maintained and is accessible when conditions are dry. <br />Well cluster GW-N41, 42, and 43 are located outside of the permit area east of previously bond released area. The <br />well cluster is near the CC ditch splitter box. These wells appear to be in good condition. Well Cluster GW- <br />N16P1,-N17P1, and -NI8P1 are located in Section 6 just north of 5th street on the south end of property that has <br />previously received final bond release and removed from the permit. This well cluster appears in good condition <br />as well, and is easily accessible. The Division is evaluating TR101, which proposes to eliminate monitoring of <br />these wells, in addition to one surface water site. <br />Ponds throughout the permit area were damp from recent precipitation, with the exception of Pond 13. Pond 13 <br />was holding a pool of water, and inflow from the underdrains was flowing into Pond 13. Frank reported that on <br />2/9/2021 he had measured 282 gpm inflow into this pond. <br />Pond 12 was not accessed due to soft conditions of the access road. SP2 was damp and not holding any water. No <br />gullying or Tilling had occurred on this stock pond. Nor did it look like the stock pond had held a pool of water <br />prior to the inspection. Pond 15 was damp with no pool of water with snowy patches in shadowed portions of the <br />pond. Pond 16 was damp with thin snow patches. Pond 18 was damp and not holding any water. <br />SP1 was damp with a small puddle of icy water in the bottom of this stock pond. The operator has applied for <br />Phase I, II, and III bond release on this pond. The bond release inspection has not yet been scheduled with all the <br />parties. The pond was in good condition. Cattle are in the field adjacent to the stock pond and can wander down <br />into the pond at will. Wood mulch on the south facing embankment outslope appears effective in reducing cattle <br />access and keeps the south facing slope protected. <br />TOPSOIL — Rule 4.06 <br />Removal 4.06.2; Substitute Materials 4.06.4(4); Storage and Protection 4.06.3; Redistribution 4.06A <br />Topsoil stockpiles are nicely shaped and left with a roughened surface. Topsoil stockpile footprints C and <br />E have been graded and left rough. Frank said these stockpile footprints have not yet been seeded. The remaining <br />topsoil resource from Stockpile H has been concentrated in a rough pile, that has been bermed and a topsoil <br />stockpile sign placed.
