Upon approval of this plan by the affected water <br />users, the Division, aryl the BII9, mining activities within the West <br />Roatcap Creek drainage can be initiated. Per stipulation, the plan was <br />developed in ooopevation with the affected water right users, and <br />federal and state authorities. <br />'Ihe Upper Cabin Spring water replacement plan entails a phased approach <br />to ensure that the water right is protected in the unlikely event <br />mining related impacts beoane evident. Phase 1): Monitoring of the <br />Upper Cabin Spring will be intensified to provide amore oa~g~lete <br />database and basis of canparison for detecting mine related iag:acts. <br />A flow meter is installed on the pipeline serving the Upper Cabin <br />Spring to continuously and aoc~rately quantify flow wlumes frtm the <br />source. CaVCC will monitor the spring on a monthly basis to record <br />instantaneous and average floc rates. NVCC ccennits to taking <br />• appropriate steps to ensure proper function of the flow meter. Said <br />steps may include installation of a cistern type stilling basin above <br />the meter installation to m;n;miye the amount of debris conveyed to the <br />meter and ensure unrestricted flow. Precipitation data from Long Draw <br />will be recorded on a monthly basis as well. Water quality samples <br />will be collected on a quarterly basis and analyzed for the standard <br />gmu+xlwater quality monitoring parameters. <br />All data generated as a result of the monitoring will be provided to <br />both the Stucker Mesa Domestic Water Company, aryl to the Division. <br />OOVCC commits to monitoring Spring 31 as specified on a monthly basis <br />for a miniminn period of 5 years following the cong~letion of retreat <br />mining within the watershed. 4he Division and the Stucker Mesa <br />Domestic Water Cong~any will be notified upon conq~letion of retreat <br />mining within the watershed. If no mine related impacts to water <br />quantity or quality are detected during the 5 year period following the <br />con~letion of retreat mining, OJVCC will petition the Division to <br />discontinue the monitoring of Spring 31. 'Itie Stucker Mesa Domestic <br />Water Company will be notified upon application to discontinue <br />monitoring. <br />Phase 2) : COVCC hereby cwtnnits to truck and deliver replacement water <br />to the Stucker Mesa Domestic Water Ca~any distribution system in the <br />event the water supply frorn the Upper Cabin Spring is suddenly <br />disrupted or noticeably diminished, or water quality is adversely <br />impacted as a result of mining. 'IYucked water will be delivered to the <br />• pipeline crossing of County Read 035 Drive above the system's lower <br />cistern.
