This <br />measure will provide a reasonable <br />chance for reproductive success for the <br />eagles. The use of [he nest will be <br />monitored by BLM and DOW. <br />According to Bureau of Land Management <br />and U.S. Fish b Wildlife Service sur- <br />veys conducted during environmental re- <br />views of CWI's coal lease areas, a <br />golden eagle nesting area is located <br />more than one-quarter mile west of [he <br />Orchard Valley West Mine site. The <br />Fish 6 Wildlife Service has determined <br />that this nesting area would not be im- <br />pacted due to the distance from the <br />mine site and screening of the mine <br />site by a ridge. <br />No endangered or threa[ened species of <br />plants or aquatic life have been found <br />in the permit area. <br />A golden eagle aerie is located approx- <br />imately 1,200 Eeet east of the proposed <br />rock slopes return portal and is <br />shielded from sigh[ of [he construction <br />area by a narrow ridge.
