52.05 APPLICATION FOR PERMIT FOR SURFACE OR DNDERGROUND MINING ACTI9ITIES -- <br />MINIMUM REQOIREMENTS FOR OPERATION AND RECLAMATION PLANS. <br />• <br />2.05.6 Mitigation of Surface Coal Mining Operation Impacts. (Cont'd.) <br />(2) (a) (i) Fish <br />The present and planned operation of the Or- <br />chard Valley and Orchard Valley LJest Mines do <br />not directly influence aquatic resources of <br />the area except (potentially) for changes in <br />water quality. (This aspect is discussed in <br />2.05.6(3)). There will be no direct distur- <br />bance of the physical habitat of the North <br />Fork or any other significant surface water <br />body that may influence aquatic life or their <br />habitat. Specifically there are no known <br />threatened or endangered species of aquatic <br />life within the waters of the permit area that <br />could be affected by mining operations. The <br />U. S. Fish and Sildlife Service has identified <br />three threatened or endangered fish species <br />which do not occupy waters within the permit <br />area, but may be negatively impacted by a de- <br />pletion of water in the Upper Colorado River <br />Basin due to CWI's coal mining operations. <br />See Section 2.05. 6(2)(a)(iii)(A) for further <br />• information, folorado Westmoreland Inc, has <br />an ongoing water quality monitoring program <br />which will be continued. This program has <br />been referred to in the previous Section <br />2.05.6(3). <br />Wildlife <br />Public use of trails on privately owned sur- <br />face within the permit area will be prohibited <br />when big game are concentrated in the winter <br />(December 1 to April 16). Tnis measure will <br />minimize disturbance during critical wintering <br />periods. Reference Section 4.18. <br />Cutting of snags will be prohibited except <br />those within the actual disturbed area re- <br />quired for construction. Tnis measure will <br />minimize the loss of perches and nesting [tees <br />fer raptors, insectivorous birds, and cavity <br />nesters. Construction activity will be pro- <br />hibited within the critical wintering area <br />during the period when deer and elk are con- <br />centrated (usually December 1 [o April 15). <br />.
