New Horizon Mine <br /> For release of bond liability for an impoundment, Rule 3.03.1(5) states, "Vegetative cover must <br /> be adequate to control erosion and similar to the reclaimed area or surrounding undisturbed <br /> area." The SP1 footprint was seeded, and vegetation growth is similar to the surrounding area. <br /> The vegetation at SP1 should not be compared to adjacent irrigated pasture areas, but dryland <br /> areas in the vicinity of the stock pond. SP 1 does not receive irrigation water; therefore, a <br /> comparison to adjacent irrigated pasture areas is not appropriate. Wooden sticks have been <br /> placed on the embankment out slope, as additional stabilization from erosion. Please see <br /> attached photographs in Appendix B of the vegetative condition of SP 1 and the wooden sticks on <br /> the embankment. The photographs were taken in October of 2020. <br /> D. Post-Mining Land Use <br /> The post-mining land use for the area applied for is a post mine stock pond, which has been <br /> constructed as provided on the as-built. Please see Attachment 2.05.3(3)-38 in Permit No. C- <br /> 1981-008 for the as-built of SP1. Appendix C contains a copy of the executed non jurisdiction <br /> water impoundment structure permit from the Colorado Division of Water Resources. <br /> E.
