NWNW, <br />NWNE, NENW, and NENE <br />T5NR92W: <br />Section 1 — Portions of: NENE and SESE <br />History of Previous Bond Release Submittals <br />The Division approved a full release of reclamation liability for the Craig Town Loadout Facility (SL1), <br />in December of 1990. That approval was for release of reclamation liability only. No money was <br />returned; meaning that no reduction in the amount of actual bond monies held by the Division occurred. <br />SL2, a request for liability release for surface subsidence effects was withdrawn in 2010. In 2019, SU, <br />a partial bond release was also withdrawn. In 2019, SL4, a partial Phase I,11 and III bond release <br />application was submitted comprising 305.7 acres and is in process at DRMS at this time (Jan 2021). <br />The SL5 application for a partial Phase I bond release was received by the Division on October 22, 2020. <br />The application was deemed complete on November 2, 2020, after the Division received proof of <br />publication of the applicant's public notice. Moffat County Mining, LLC published notice of the bond <br />release application in CO Mountain News Media - Craig Daily Press once weekly for four consecutive <br />weeks, beginning 30 October 2020. Moffat County Mining, LLC also notified land owners within and <br />adjacent to the mine permit area, and other interested parties of the application for bond release, as <br />required by Rule 3.03.2(1). No comments, written objections, or requests for an informal conference <br />regarding the bond release application were received by the Division. The specific area to which this <br />bond release request applies within the Permit Area is located as follows: <br />T6NR91W: <br />Section 31 — Portions of NW 1/4, NE'/4 , SE'/4 , SW 1/4 Section 32 — Portions of NWNW, <br />SWNW, NWSW, and SWSW <br />T5NR91W: <br />Section 6 — Portions of NWNW, SWNW, and NENE <br />Reclamation for the requested 176.7 acres of Phase I bond release areas was conducted between 1998 <br />and 2020, building and structure demolition took place between 2006 and 2020. The SL5 bond release <br />request comprises areas designated as cropland, pastureland and rangeland. Mine water treatment ponds <br />(5-P5, 5-P6 and 5-P7) and the wastewater treatment pond were backfilled, regarded and topsoiled. All <br />other ponds remain in place for sediment control. Topsoiling occurred in autumn of 2019 and DRMS <br />verified topsoil depths in October 2019 as per the inspection report file. <br />MCM is requesting Phase I bond release on 176.7 acres as per the SL 5 Phase I Bond Release Map <br />submitted with the application. The Division scheduled and conducted a bond release inspection on 4 <br />November 2020 after finding the application complete and informing all sister agencies and interested <br />Permit Number.
