PERMIT#:M-2008-076 <br /> INSPECTOR'S INITIALS: DC <br /> INSPECTION DATE: December 18,2020 <br /> A large stockpile of cut trees was seen on the south eastern side of the affected land and appears to have <br /> been removed from Area 2. Trash piles and refuse were seen containing tires, buckets, scrap metal, and <br /> destroyed culverts. <br /> There has been no progress in grading the highwall that is located on the southern end of the affected area <br /> since the February 2020 inspection. <br /> The Division finds that additional reclamation work is now needed in Area 1 to fully bring the site into <br /> compliance with the Board order. The Operator will need to regrade all slopes to a 3H:1V ratio to repair the <br /> erosional issues, grade the southern highwall to 3H:1V ratio, and remove all trash and refuse from the site, <br /> and revegetate all graded slopes to prevent further erosion and/or take other measures to stabilize the slopes. <br /> Area 2: <br /> The crusher that was previously at the top of Area 2 has been moved down to the main mine floor. <br /> A large area that was previously undisturbed has had a large amount of trees removed (Photo 21). There are <br /> still large piles of material at the top of Area 2. It appears that minimal work has been conducted and small <br /> amounts have been removed from each pile. <br /> Area 3: <br /> During the inspection, the previous noted impoundments in Area 3 appear to have been removed, however <br /> the Operator has not communicated with the Division or provide any evidence to show that they are in <br /> compliance with regulations. <br /> Based on the Division estimates, the Operator will need to continue to conduct reclamation work and <br /> complete all earthwork at the site to reduce the reclamation liability to the currently held $52,815.00. <br /> Conclusion: <br /> The operator has yet to comply with the Boards Order, an additional aerial inspection will be conducted in the <br /> near future. <br /> It appears the operator has likely violated the cease and desist order, the Division will investigate this further. <br /> Should evidence not be submitted documenting compliance with the Board's order the Division shall pursue <br /> final forfeiture of the financial warranty. All suspended civil penalties will become due and payable. <br /> The operator may be in violation for failing to comply with the Board Order which may be considered as a <br /> separate violation to be considered at a future board hearing. <br /> Page 3 of 15 <br />
