PERMIT#:M-2008-076 <br /> INSPECTOR'S INITIALS: DC <br /> INSPECTION DATE: December 18,2020 <br /> OBSERVATIONS <br /> Introduction: <br /> The Robinson Sons Gravel Pit No.1 was inspected by Daniel Cunningham of the Division of Reclamation, <br /> Mining and Safety (Division/DRMS) on December 18, 2020. No one was present to represent the Operator. <br /> The inspection was conducted to determine how much reclamation work had been completed since the <br /> Mined Land Reclamation Board (MLRB/Board) hearing in May of 2020. The site was previously inspected by <br /> the Division on October 1, 2020. Approximately 26.8 acres of the permit area has been disturbed to date with <br /> 17 acres affected in Area 1, 2.3 acres in area 2, and 7.5 acres in reclamation along the Wet Canyon creek, the <br /> remainder of the site is undisturbed. <br /> The Operator is currently under a board order (MV-2019-005) to complete corrective actions by December 27, <br /> 2020. The Board ordered permit M-2008-076 revoked and issued a cease and desist order for the operation. <br /> The Board imposed the following corrective actions against Robinson Sons: <br /> 1. By December 27, 2020, advance the reclamation of affected lands as necessary to ensure sufficiency of <br /> the existing$52,815.00 financial warranty; or <br /> 2. By July December 27, 2020, submit to the Division the additional financial warranty in the amount of <br /> $120,915.00. <br /> Inspection: <br /> Several attempts were made to contact the Operator before the inspection, to include phone calls, voicemails, <br /> and emails with no response. <br /> Area 1: <br /> Several new stockpiles of mined material were seen throughout the primary pit excavation in Area 1. It <br /> appears the Operator has been mining on site and has moved the processing equipment from Area 2 to Area <br /> 1. By the Board's order, no mining is authorized to occur at the site. These large stockpiles, which consist of <br /> large boulder size river rock and varying sizes of crushed material was not present on site during the October <br /> 1, 2020 aerial inspection. In addition to the large piles of material, several areas that were previously graded <br /> now have large erosional issues that vary from two to four feet in depth, vary in length, and are seen <br /> throughout the entire affected land. This is noted as an additional problem at the beginning of the report. <br /> The pool of water impounded in the pit excavation that was previously noted in the September 2019 <br /> inspection report, the December 2019 inspection report, the February 2020 inspection report, and the <br /> October 2020 inspection report is still located on site. The Operator was informed in all of the previously <br /> mentioned reports that the basin would need to be removed and natural drainage would need to be <br /> established.The Operator was given until November 11, 2020 to address the impounded water or provide <br /> documentation from the State Engineer's Office (SEO) showing the impoundment was authorized. As of <br /> December 18, 2020 neither the proof of authorization or natural drainage has been provided or reestablished. <br /> Page 2 of 15 <br />
