ground water in the mining and adjacent areas, the mining operation and subsequent reclamation should have no adverse
effect on existing or potential ground water recharge capacities and adjacent users.
4,05.13 SURFACE AND GROUND WATER MONITORING
EC will continue their current program of monitoring surface and ground water quality and quantity throughout the term of
the planned mining operations, as set forth in Exhibit 29, Water Quality Monitoring Manual - EC. The monitoring program
will serve as an integral part of the program for protection of the hydrologic balance by detecting any possible problems
with respect to water quality or quantity.
4.05.14 TRANSFER OF WELLS
EC does not presently plan to transfer any monitoring wells to water wells.
4.05.15 WATER RIGHTS AND REPLACEMENT
EC, if necessary, will replace the water supply of any owner of interest in real estate who obtains all or part of the supply of
water for domestic, agricultural, industrial, or other legitimate use from underground or surface source where the water
supply has been affected by the mining operation.
Ground water and surface water uses are limited in the vicinity of EC. The uses are limited because of the lack of
available water in the area and relatively limited demand.
EC does not anticipate that any water supply or water right of any owner of interest will be affected by the mining
operation. Water rights in the vicinity of EC were examined, with all water rights and well locations shown on the Water
Rights Map (Map 18). Wells in the vicinity are tabulated in Exhibit 11, Water Rights.
4.05.16 DISCHARGE WATER INTO AN UNDERGROUND MINE
No surface water will be diverted or otherwise discharged into any underground mine workings.
4.05.17 POST-MINING REHABILITATION OF SEDIMENTATION PONDS, DNERSIONS, IMPOUNDMENTS,
AND TREATMENT FACII.ITIES
Sedimentation ponds and temporary diversions will be removed upon satisfaction of requirements in Section 4.05.2(2) of
the Regulations of the Colorado Mined Land Reclamation Board for Coal Mining.
4.05.18 STREAM BT JFFER ZONES
No mining or associated activities aside from the two (2) exceptions described below shall disturb any land within 100 feet
of a perennial stream or a stream with a biological community as defined by Rule 4.05.18(3). The two (2) exceptions are
the coal storage silo and the 48-inch cross-country conveyor which have been previously approved by the CMLRD. The
locations of these two (2) stmctures are shown on the Stmctures and Renewable Resources Map (Map 25).
4.06 TOPSOII.
4.06.1 GENERAL REOT.IIREMENTS
All surface disturbance described in this application has occurred either during previous EC operations or previous to
the EC mining operation. However, prior to any new surface disturbance, all suitable topsoil material will be
Permit Revision 04-34 4.01-6 Revised 7/2/04
