b. Task 79 is unknown and can remain in the cost estimate until further investigation. <br />Rule 4.05.6(13) Permanent Impoundments <br />6. Please inform DRMS as to the status of Pond 9AP1 in the Strip Pit. Will the Pond be reclaimed or <br />retained? <br />a. Pond 9AP1 was approve as permanent in 1992 under TR21. <br />b. Included with this submittal is the final approval from the State engineer for the retention of <br />Ponds 9AP3 and 9AP4. <br />c. 9AP2 was denied due to the vertical height exceeding 15 feet. For the time being updated <br />permit pages have been updated and are included in this submittal to remove 9AP2 from the <br />permanent features. <br />Rule 4.16(13) Alternative Land Use <br />7. Please demonstrate that Moffat County Mining has received the approval for all changes in the land use <br />between the two Maps and can meet the requirements of Rule 4.16(13)(6). <br />a. Land uses changes occurred on both the State of Colorado land and on Sage Creek Holdings. <br />LLC land. Included is a letter from Sage Creek Holding approving the land uses change from <br />pastureland to cropland for the parcels along the Williams fork river. <br />b. We are awaiting approval from the State Land Board, this approval will be sent to DRMS as <br />soon as it is received by MCM. <br />Review of Revised Pages <br />8. Please either update Table 67 and Exhibit 25 or provide a rational as to why the information should <br />remain as currently documented in the permit. <br />a. Table 67 was updated and included in this submittal to reflect the current reclamation status. <br />9. Please review page 2.05-31-1 as there appears to be missing language in paragraph heading: Fresh <br />Water System, regarding the retention of permanent features. <br />a. The fresh water wells will remain as permanent features. The text has been updated to reflect <br />this. <br />10. Also, language with regards to the sealing of the boreholes changed. Please explain the change in the <br />borehole language. <br />a.
