Please clarify if the operator intends to use broadcast seeding methods. <br /> Broadcast seeding will be used for the seedbed areas. I have corrected the Exhibit <br /> L - Reclamation Cost Estimate to remove any reference to drilling. <br /> EXHIBIT G—Water Information (Rule 6.4.7): <br /> 16. Please incorporate comments made the Division of Water Resources, see Attachment 1, regarding <br /> the exposure of groundwater, storm water detention structures and source of water used for dust <br /> control into this section. <br /> The second paragraph of this exhibit states that no groundwater will be exposed. <br /> Section CRS 37-92-602(8)(i)(A) states (A) Is owned or operated by a governmental entity <br /> or is subject to oversight by a-governmental entity; The stormwater ponds, proposes are <br /> effectively shallow depressions that capture the minor amount of stormwater that <br /> runs off the disturbed area right after a storm. Summit Brick is not a government <br /> agency so these ponds are not required to be registered. A statement to this affect <br /> has been added to Exhibit G. <br /> Exhibit G says the water used at the mine is hauled from the Brick Plant. This <br /> water comes from the city water system. As industrial use water it is an allowed <br /> for used at the mine and has been going on for at least 50 years. <br /> EXHIBIT J—Vegetation Information (Rule 6.4.10): <br /> 17. Please provide the relationship of present vegetation types to soil types, or alternatively, the <br /> information may be presented on a map pursuant to Rule 6.4.10(1)(b). <br /> I revised Exhibit J to show the undisturbed area vegetation and added a Vegetation <br /> map - Figure J-1 show the vegetation areas on a soils map. <br /> EXHIBIT M—Other Permits and Licenses (Rule 6.4.13): <br /> 18. In item #2, it is stated that the area covered by the Pueblo County Exemption is shown on Map <br /> Exhibit C yet the Division does not see where this is indicated, please show this area. <br /> The explanation in Item #2 was a mistake it should have referred to the City of <br /> Pueblo since the permit area is within the limits of the Pueblo. I have corrected <br /> that item and enclosed copies of the 1977 Non-conforming use documents for your <br /> review. The map attached to the non-conforming certification, shows the area <br /> encompasses the 35.23 acres we have included in the permit. A copy may be in the <br /> existing file but to keep the file current I have revised Exhibit M - Other Permit <br /> and Licenses to include these documents. <br /> 19. Please commit to providing copies of all the new and or updated permits once they are approved. <br /> Summit will submit copies of all new and updated permit listed in Exhibit M, if <br /> needed, as they become available. <br />
