OTHER PERMITS AND LICENCES <br /> Rule 6.4.20(5)requires a list any air,water quality,solid and hazardous waste,and other federal,state permits <br /> or local licenses, or other formal authorizations which the Operator/Applicant holds or will be seeking <br /> applicable to the use, handling,storage, or disposal of designated chemicals and acid mine drainage-forming <br /> materials within the permit area. <br /> The Schwartzwalder Mine operated under Colorado Mining Permit#M-1977-300,Colorado Discharge Permit <br /> #CO-0001244 and Radioactive Materials License CO-369-03. <br /> • Colorado Mining Permit#M-1977-300:The mine permit(M-1977-300) was issued by the State of <br /> Colorado in 1977 the permit disturbance boundary covered by the permit is shown in Figure C-1. <br /> • Colorado Discharge Permit#CO-0001244: Discharge Permit#CO-0001244 was issued in 1981 by <br /> the Colorado Department of Public Health and Environment, Water Quality Control Division for the <br /> Schwartzwalder water treatment plant. The monitoring requirements associated with the discharge <br /> permit and corresponding NOV/Cease and Desist Order(order#I0-100601-1)are described in Exhibit <br /> E. <br /> • Radioactive Materials License number CO-369-06:A new Radioactive Materials License#CO-369- <br /> 06 was issued by the CDPHE Hazardous Materials and Waste Management Division in July 2010 and <br /> renewed in June 2020. This license authorizes storage, possession and ownership of radioactive <br /> materials associated with an ion-exchange water treatment system. <br /> • Air Quality Permits: There is one air permit #97JE0037F associated with the Site reclamation <br /> activities(dust suppression for grading and earthwork). <br /> • Storm Water Discharge Permit:The Colorado stormwater discharge permit#COR-040046 has been <br /> in effect since March 19,1993.The stormwater management plan(updated in May of 2010) identifies <br /> potential sources of pollution (including sediment) which may reasonably be expected to affect the <br /> quality of stormwater discharges associated with the mine and describes the best management <br /> practices(BMPs)used to reduce pollutants in stormwater discharge. <br /> • Well Permits Water Resource Permit Number 64684:issued September 22, 1972,by the Office of <br /> the State Engineer for the non-industrial domestic water well. All monitoring wells have been <br /> permitted through the Colorado Division of Water Resources. <br /> • U.S.Army Corps of Engineers: The U.S.Army Corps of Engineers issued a nationwide 404 permit <br /> (Corps File No. NOW-2011-013530-DEN) for performing the alluvial fill material excavation along <br /> Ralston Creek. <br /> • U.S.Fish and Wildlife Service:The U.S.Fish and Wildlife Service issued a biological opinion(February <br /> 2016)as part of the aforementioned U.S.Army Corps of Engineers permit. In this biological opinion, <br /> the Colorado Ecological Services Field Office finds that the alluvial valley exaction may affect the <br /> Preble's meadows jumping mouse and it's critical habitat,but the project is not likely to jeopardize the <br /> NOVEMBER 2020 53 AMENDMENT 5 <br />
