Miranda Kawcak <br />Page 3 of 3 <br />2020 October 29 <br />Rule: 4.05.6(13) Permanent Impoundments <br />October 2020 DBMS: Moffat County Mining provided Exhibit 38, comprising permanent pond <br />approvals for the classification of livestock water tanks with the TR38 permitting action. The <br />approvals, provided by the Division of Water Resources meet the requirements of the above <br />mentioned rule and pertains to ponds 9AP2, 9AP3, 9AP4. <br />6. Please inform DRMS as to the status of pond 9API in the Strip Pit. Will this pond be <br />reclaimed or retained? <br />Rule: 4.16(13) Alternative Land Use <br />October 2020 DRMS: DRMS compared Maps Map 3 Premining Land Use, and the submitted Map <br />29 Reclamation Plan Map. It appears that the land use designations have changed from pastureland <br />to cropland in areas along the Williams Fork River and to cropland in various parts of the permit <br />area. Land use changes may be approved by the Division as per Rule 4.16.3 through a permitting <br />action and consultation with landowners or land management agency. <br />7. Please demonstrate that Moffat County Mining has received the approval for all changes <br />in land use between the two maps and can meet the requirements of Rule 4.16(13)(6) <br />Review of Revised Pates <br />Page 2.05-25 under heading Reclamation Timetable and Costs references Table 67 and Exhibit 25. <br />With TR38 DRMS believes that the information in the table and the exhibit may require updating. <br />8. Please either update Table 67 and Exhibit 25 or provide a rationale as to why the information <br />should remain as currently documented in the permit. <br />It appears to DRMS that the discussion of Pond reclamation on page 2.05-31-1 should possibly <br />include information on the possible future request for permanent ponds. <br />9. Please review this page as there appears to be missing language in paragraph heading: Fresh <br />Water System, regarding the retention of a permanent features. <br />10. Also, language with regards to the sealing of the boreholes changed. Please explain the <br />change in the borehole language. <br />TR38: Preliminary Adequacy <br />
