20. State that no trees/nursery stock will be used.
Please see the revised Exhibit E.
21. State that no fertilizer will be used.
Please see the revised Exhibit E.
22. State the maximum reclaimed slope.
Please see the revised Exhibit E.
Exhibit G
23. Commit to providing the Division with a copy of the wetland study and make permit
revisions as necessary.
The Division will be provided with a copy of the wetland study for the site. If the results of the
study necessitate revisions to the permit, a technical revision will be filed.
24. Section 7.1-Typo should be Area 1 described first then Area 2 described, not Area 2
twice
Please see the revised Exhibit E.
25. Typically one permit is not dependent on another. Explain the rational for using M-
1900- 094 to dewater Area 2 rather than pumping into Area 1.
The Orchard Grove Industrial Pit (M-1990-094) has an active CDPHE discharge permit for
dewatering. Using that pit, while present, as a sediment pond for Area 2 dewatering will facilitate
Area 2 mining for the landowner of both pits (A&G Partnership)while avoiding a water line
across a public road.
26. De-watering of Area 2 is dependent on the neighboring Orchard Grove Industrial Pit
(M- 1990-094). Please provide documentation from CDPHE that this is an acceptable
means of discharge.Additionally M-1990-094 will need a technical revision to make
commitments to support the M-2020-035 operation with regards to dewatering through
life ofmine,
Elam has reached out to CDPHE for documentation that running the Area 2 dewatering water
through Orchard Grove Industrial Pit's (OGIP) existing discharge permit(COG500263) is
feasible. In case it is determined to be infeasible, an additional dewatering pump location,
sediment pond, and discharge point has been added to Area 2. It can be seen on Map C-2. This
alternative location will be the fallback for Area 2 dewatering under its own CDPHE permit. The
alternative discharge point on the north side of Area 2 can also be used in the event that OGIP is
not able to take on Area 2's dewatering flow.
27. Section 7.1-does M-1990-094 also discharge into the Wilsea Drain? If not clarify the
discharge point that Area 2 would ultimately use.
23 114 West Pit 5
October 2020 --
