2. Structures within 200 feet of the affected land.
All of the structures referenced the technical review belong to Chuck and Rebecka
Osborn and include a few permanent and portable structures described as such:
The Osborn residence is a 26'x 50'modular wooden frame structure with wood
product exterior siding, south and west of the Osborn residence is a 12'x
12'wooden framed/metal sided storage shed, immediately south of the shed are
six portable animal shelters, wooden framed/metal sided, a 10'x 12'wooden
framed chicken coop, a 42'in diameter round pen defined by portable corral
panels, and 75'x 100'arena area also defined by portable corral panels, and a 40'x
60'wooden framed/metal sided barn. All of the structures referenced above are
included in an executed structures agreement. All fence lines bordering the mine
property as well as interior fences that will be removed and replaced are covered
under the lease agreement between Kagan and Osborn.
6.4.4 EXHIBIT D—Mining Plan
3. Exhibit D Working Areas. The mine plan narrative attempted(obviously not
clear enough) to define the four phase areas for purposes of bonding while also
describing the method used for gravel extraction that works smaller areas within
the designated phase area, thus allowing bulldozer removal and replacement of
overburden and planting media as compared to other equipment that might be
used for soils removal, transport, and replacement at the conclusion of gravel
extraction in that area. For purposes of bonding calculation, Phase 1 is 12.3 acres
in area. Once bonding is in place and approved by the Division, mining will
proceed as described in the mine plan narrative in smaller increments (3-4 acres
of disturbance) until the 12.3 acre phase 1 area is mined of gravel resource. Prior
to disturbance, phase 2 will have bond in place, as will be the case for phases 3
and 4.
6.4.5 EXHIBIT E—Reclamation Plan
4. Sediment Ponds. After review of Fremont County Engineer's comments (copy
included) regarding the need for detention and the consideration of impact of
storm run-off from reclaimed areas, the applicant has decided to remove the
sediment pond at the conclusion of mining and reclamation activities. All
reference to retention of the sediment ponds in the narrative sections of the
mining and reclamation plan have been removed or corrected. Pages 1-8 of
Exhibit E—Reclamation Plan edited are included in this mailing.
5. Rule 3.1.6(3)—Stabilized/Protected Affected Land. The applicant proposes to
leave only the main haul road and a circular loop of roadway(22')as the final
gravel covered area on site. The final gravel covered area is estimated to be
approximately 3500'x 22'wide—2 acres. Thus, total reclaimed land area will be
87.5 — 11(no-mining area along Eight Mile Creek) = 76.5 —2= 74.5 acres.
`PFso Q. -2—
