a new application (dated December 14, 1992) to operate the coal loading facility pursuant to <br />the Regulations of the Colorado Mined Land Reclamation Board for Coal Mining. <br />In 2010, the operating entity was changes to a limited liability company, and HGTI became <br />Hayden Gulch Terminal, LLC (HGT). The rail spur areas are currently utilized under a lease <br />agreement with the Town of Hayden as a recreational trail system in a locally managed Tracks - <br />to -Trails Program. A request for a land use change at Hayden Gulch Loadout, PR02, was <br />submitted to CDRMS on September 22, 2020 to change the land use at the majority of the <br />facility to recreational. In conjunction with the application for land use change, Hayden Gulch <br />Terminal, LLC submits this request for full bond release of the noted area, to be fully utilized <br />in the future by the Town of Hayden as a year-round recreational space. <br />This application is submitted in accordance with the Colorado Division of Minerals and <br />Geology Guideline Regarding Selected Coal Mine Bond Release Issues (April 18, 1995), Rule <br />3.03 Release of Performance Bonds. <br />BOND RELEASE BACKGROUND INFORMATION <br />This submittal represents a formal full bond release request by Hayden Gulch Terminal, LLC <br />(HGT) for a portion of the Hayden Gulch Loadout (Hayden Gulch). Hayden Gulch Terminal, <br />LLC submitted a permit revision PR-02 on September 22, 2020 requesting a change in post - <br />mine land use of the former rail spur areas for recreational use, consistent with the transfer of <br />this area to the Town of Hayden (Hayden) for recreational use under a local "Tracks -to -Trails" <br />program. <br />Coal was handled and shipped from this facility through 1987, and the last active use of the <br />facility was for temporary coal storage in 1992. The loadout facilities were removed, and the <br />associated disturbance areas reclaimed in 2011 — 2012, and beginning in 2016 through 2019, <br />the railroad spur track, ties, and ballast were removed and a parking area for the future trail was <br />constructed. HGT and the Town of Hayden entered a lease for the property in 2020 and are <br />utilizing the area as a recreational trail. <br />
