Frank Ferns of ERMR <br />accompanied the inspection and represented the permittee. Ms. Yeldell is accompanying the inspection in the <br />capacity of cross -training coal mine inspections since the formation of the Active Mines program. COVID-19 <br />protocols were followed. Site specific safety training was conducted at the New Horizon Mine office prior to the <br />start of the inspection. <br />The weather was mild and dry. The region has not received any precipitation for an extended period of time. <br />AVAILABILITY OF RECORDS — Rule 5.02.4(1): <br />Mine Records were checked at the New Horizon Mine office. Availability of Records form accompanies <br />this report. <br />BACKFILL and GRADING — Rule 4.14 <br />Contemporaneous Reclamation 4.14.1; Approximate Original Contour 4.14.2; Stabilization of Rills and Gullies <br />4.14.6: <br />The irrigation system was not operating at the time of the inspection. The Irrigated Pasture field had been <br />cut, baled, and the bales removed. The Irrigated Pasture was dry. The low spot identified on the northwest side of <br />the field in August has dried up. This spot appears to be a result of differential settling. If the operator chooses <br />not to level this spot during the winter months, work should be conducted to assure this area drains without <br />ponding. Drainage off this area is captured by Pond No. 2. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Ground Water Monitoring 4.05.13; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />Both Pond No. 1 and Pond No. 2 were dry. Pond I discharge structure is clear of debris and appears <br />functional. (Photo 3) <br />Ditches throughout the permit were clear of debris and in good repair. The operator has cleared the tree saplings <br />that had begun to establish in the bottom of NHN-002 south ditch.
