August 26, 2020 C-1981-008/New Horizon Mine JHB <br /> the repairs that ERMR had conducted on his pasture, and removal of gravel and sediment. He also said that the <br /> ditch that had sediment deposited in it, he had planned to take out anyway, so, it hadn't been problematic for him. <br /> Frank was in good communication with Mr. Enstrom regarding mitigation work necessary. <br /> The ditch on the south side of BB road on the north side of the irrigated cropland field(Morgan property) (IC)has <br /> been adequately cleaned of sediment. ERMR had placed straw in the head cut of the drainage swale in the IC, and <br /> placed heavy duty silt fence at the north end of the swale, outside of the cropped field. Care was taken not to place <br /> the silt fence where it would impede the farmer. <br /> The Rotation crop appeared to be growing well. There were a few small spots on the north side of the field that <br /> don't appear to have good crop cover. <br /> TOPSOIL—Rule 4.06 <br /> Removal 4.06.2; Substitute Materials 4.06.4(4); Storage and Protection 4.06.3;Redistribution 4.06.4: <br /> The operator was in the process of hauling topsoil from the facilities area topsoil stockpile to the Benson <br /> East property to fill low spots in this field. The Benson East property is no longer within the permit area boundary <br /> as a result of approval of SL-22, and TR-98. Utilization of excess topsoil at the facilities area stockpiles was <br /> approved for this purpose with MR115. This field had experienced differential settling after irrigation throughout <br /> the liability period. Low spots had been holding water and causing difficulties in managing the irrigated pasture. <br /> The topsoil placement was in accordance with the approved permit. <br /> ERMR had also placed topsoil in low spots at the Benson West irrigated pasture. Benson West pasture remains <br /> within the permit area. Topsoil had been placed in the low areas, a little thicker than the surrounding area to allow <br /> for consolidation once the soil material is irrigated and settles. This practice is appropriate. Frank said that they <br /> had surveyed the area of repair, and assured that less than 5% of the reclaimed area had been repaired. This <br /> mitigation to the Benson West Irrigated Pasture was acceptable. <br /> The topsoil stockpiles at the facilities area were inspected. The operator has staked the north end of Topsoil <br /> Stockpile H staked to make it clear to equipment operators where the limits of utilization of the pile is located. <br /> Topsoil stockpile D is not being used for the current irrigated pasture topsoil placement project. Equipment was <br /> loading topsoil from the south end of Stockpile H and some of topsoil stockpile E. Frank said that topsoil <br /> stockpile E will be shaped once the project is completed. The Division observed that the operator is <br /> communicating well with the equipment operators on which piles to use, which topsoil resource not to use, and <br /> was very clear communicating where the topsoil resource was to be placed.
