LANIiSTON" <br />l V10J: L h;f --49 <br />Oak Creek crosses the access road on the Northern end of the property. Currently, there is a low <br />water crossing for access into the property. Storm Water Management controls have been set in <br />place to help with any erosion into the creek bed from road construction activities. Natural <br />vegetation has begun to sprout this spring and the land is taking well to the help mother nature <br />has offered. Active run-off into the creek is not anticipated outside the realm of normal storm <br />events. <br />Since taking ownership of the land, Mike Langston has only witnessed live water in the creek <br />during storm events. It is hard to accurately depict the history of the creek, but given its current <br />nature, and the nature of the last four years, it is considered to be a dry creek. The adjacent land <br />owner directly West of the property has a similar access erected into his land and it appears to <br />serve his egress needs just fine. <br />In the event the creek does surface, or begin to flow, we will cease operations until it subsides. <br />Within the history of what has been witnessed, the events of water flow are short lived and pass <br />relatively quick. Stormwater has not been witnessed in the creek for more than a 24 hour period <br />at a time. We do not anticipate a need to do anything different with the low water crossing. The <br />creek is also located at the entrance of the property and is not within 200' of the actual extraction <br />location. <br />The other water feature in the area is the Minnequa Canal. This canal is on record as being <br />owned by CF&I (Colorado Fuel & Iron Company). To our knowledge, CF&I sold to Rocky <br />Mountain Steel, and then to Evraz North America. This is a privately owned water feature. We <br />will comply with whatever requests Evraz may have on the canal. However, we anticipate to be <br />excavating well above the spring line of the ditch and do not feel any additional requirements <br />will be needed.
