Proposed Decision <br /> The Colorado Division of Reclamation,Mining and Safety Proposes to APPROVE the Application <br /> for Permit Revision No 9(PR9). <br /> The application was submitted by Trapper Mining, Inc. on 15 March 2018. This decision is based on <br /> a finding that the operations comply with all requirements of the Colorado State Program as found in <br /> the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., and the Regulations <br /> promulgated pursuant to the Act. If no request for a formal hearing is made within thirty(30) days of <br /> the first publication of the issuance of this proposed decision,then this decision becomes final. The <br /> permit will be renewed upon submittal to DRMS of acceptable surety by the applicant. The permit <br /> application, all supporting documentation and any stipulations or conditions become a binding part of <br /> the permit. <br /> No coal mining operations may be conducted on any Federal surface or coal until the Assistant <br /> Secretary for Lands and Minerals Management with the U.S. Department of the Interior has <br /> approved any required federal mining plan or modification thereof if required. <br /> This proposed decision encompasses the addition of 1.4 acres of disturbance acres for PR9. <br /> Originally, TMI requested an additional 564 acres of disturbance with PR9 but during the course of <br /> the review substantial changes occurred to TMI's proposed future operations whereby a new plan <br /> was created. Also, during the review TMI applied for several revisions which ultimately reduced the <br /> amount of new disturbance requested by TMI through PR9. All this resulted in a net increase of <br /> affected area of 1.4 acres. During the review of PR9, TMI received approval of the following <br /> revisions: <br /> o An additional new disturbance of 84.0 acres and redisturbance of 161.4 acres associated with <br /> TRI 19 for a total of 245.4 acres of disturbance. <br /> o An additional 6.5 acres of new disturbance associated with the coal stockpile per TR121 <br /> o An additional 21.31 acres for an administrative adjustment was added per TR122 <br /> o An additional 201.4 acres of redisturbance in N Pit for mining per TR124 <br /> Mining will continue in L Pit,N has been reopened. Reclamation will continue in Kimber(K), <br /> Lancaster(L),Ashmore(A), and Darringer/Enfield(D/E)Pits. <br /> During the permit revision number 7 (PR7)process, Trapper proposed no new disturbance within the <br /> 795.72-acre PR7 permit expansion area at the time (2015). Baseline information required by the <br /> regulations for future areas of mining was not submitted with PR7. The following Stipulation#22 <br /> was therefore attached to TMI's permit and was put into effect for the PR7 permit expansion area. <br /> The items comprising the stipulation were incorporated into PR9 as was the construction of new <br /> ponds located in the Deal, Deacon and Jeffway drainages and associated with Stipulation 21 <br /> (previously complied with).
