DNR <br />COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />Date: August 10, 2020 <br />To: Rob Zuber <br />From: Zach Trujillo <br />CC: Jason Musick <br />RE: Bowie No. 2 Mine, DRMS File No. C-1996-083 <br />Waste Bank Review <br />As requested, I have reviewed Bowie Resources, LLC's Bowie No. 2 Mine 2020 1St Quarter Waste Bank <br />Inspection Report. Due to the COV1D-19 virus and the state of Colorado Stay at Home order at the time <br />of the required inspection, a complete gob pile inspection was not performed during the 1st quarter of <br />2020 and the visual inspection was conducted on May 7, 2020. However, instrumentation monitoring did <br />occur during the 1St quarter and has been provided as part of the Bowie No. 2 waste bank inspection. The <br />Bowie No. 2 Mine 2020 1St Quarter Waste Bank Inspection Report was reviewed for compliance with the <br />following Rules: <br />1. 4.09. 1 (1 1)(a) — The fill was inspected for stability by a registered engineer during the placement <br />and compaction of fill materials. No placement occurred during the 1St quarter. <br />2. 4.09.1 (1 1)(b) — A qualified registered engineer provided to the Division a certified report within <br />two weeks after the visual inspection of the waste bank was completed. As stated earlier in the <br />report, due the Colorado Stay at Home order, the visual inspection was delayed to May 7, 2020. <br />The associated report was then provided to the Division within the two weeks of the delayed <br />inspection. <br />3. 4.09.1(11)(c) —This rule is not applicable during this phase of construction. <br />4. 4.10.2 — All criteria for Rule 4.10.2 were met. <br />The following is a summary and notes in regards to the Bowie No. 2 Mine 2020 1St Quarter Waste Bank <br />Inspection Report: <br />• Recommended cleaning and general maintenance on the upper and lower diversion at gob pile #3 <br />and culvert JI were performed during 2019. This maintenance item was noted in the 2"a Quarter <br />Waste Bank Report as well. <br />• The seep north of the east drying area of gob pile #3 continues to flows. Based on the comments <br />in the report, the seep is connected with the Fire Mountain Canal and the Operator has notified <br />the associated party in regards to loss of water from the canal.
