Dear Ms.Yeldell: <br /> Division inspected the Fontanari permit area and property on June 1 and 8, 2020. <br /> Certain of the inspection results resulted in the issuance of a "Reason to Believe" Letter <br /> dated June 17, 2020,setting a hearing for the July 2020 Board meeting, later delayed to <br /> the August 2020 Board Meeting. Fontanari would like to make a first response to some <br /> of the other concerns raised in the inspection reports. <br /> Weed Control <br /> Fontanari and one assistant recently spent a full %:day on weed control spraying on the <br /> property.That effort is described in the attached letter from Mr. Fontanari dated July <br /> 21,2020. <br /> There seems to be some confusion related to contact with Montana Cohn of Mesa <br /> County Noxious Weed & Pest Management. I am informed that Fontanari contacted <br /> Mr. Cohn in February,2020 but Cohn did not want to do a weed inspection until spring <br /> weather and rains placed the weeds in bloom.With the Covid situation, that inspection <br /> happened in June.The Cohn report is also attached. <br /> No Class A noxious weeds were identified.The only Class B weed identified was the <br /> Scotch Thistle. It was terminated.The remaining spraying was of Class C noxious weeds. <br /> HiQhwall Scaling on Haul Road <br /> Your report and photos identified scaling work and road grading along the haul road. In <br /> the experience of Fontanari, this work must be performed on average every two years <br /> depending on many factors leading to identified instability, including winter freeze <br /> thaw, settling from subsidence and precipitation leading to erosion of supporting rocks <br /> and soils.As you know,there is cap rock instability in this area along 1-70 and wherever <br /> steep slopes are present, and the instability presents multiple safety issues which <br /> operator is obligated to address. <br /> The two primary issues in this area are the risks to life, limb and equipment from <br /> rockfall.We have attached as Exhibit A photographs of the scaling work area and the <br /> final repository of the large pieces of caprock dislodged from and unsafe position and <br /> Page 02 <br />
