Notwithstanding any provision to the contrary in this Order, the Application, or the <br /> Engagement Letter, the U.S. Trustee retains all rights to object to the reasonableness of EVA's <br /> request(s) for monthly, interim, and final applications for compensation and reimbursement of <br /> expenses based on the reasonableness standard provided for in section 330 of the Bankruptcy <br /> Code; provided that reasonableness for this purpose shall include, among other things, an <br /> evaluation by comparing the fees payable in this case to the fees paid to other sale advisory firms <br /> for comparable services in other chapter 1 I cases and outside of chapter I 1 cases, and shall not be <br /> evaluated primarily on the basis of time committed or the length of these cases. <br /> 8. EVA is authorized to keep reasonably detailed time records in half-hour increments <br /> and will submit, with any interim or final fee application a narrative summary,by project category, <br /> of services rendered and will identify each professional rendering services,the category of services <br /> rendered, and the amount of compensation requested. <br /> 9. EVA is granted a waiver of the information requirements in the Procedures for <br /> Complex Chapter 11 Cases attached to the General Order relating to compensation requests to the <br /> extent requested in the Application. <br /> 10. The Debtors and EVA are authorized to take all actions necessary to effectuate the <br /> relief granted pursuant to this Order. <br /> 11. Notwithstanding any Bankruptcy Rule to the contrary, this Order shall be <br /> immediately effective and enforceable upon its entry. <br /> 12. The relief granted herein, including, without limitation, approval pursuant to <br /> section 328(a) of the Bankruptcy Code of the Fee and Expense Structure, shall be binding upon <br />
