RE: Request for Full Release of Permit Area and Financial Warranty <br /> for Star Water Resource, DRMS Permit# M-1977-522 <br /> The remaining permit areas which required vegetation have been re-vegetated and are acceptable to <br /> the new property owner. L.G. Everist hired seeding contractors to vegetate the areas around, and <br /> south of, the East Lake. There is now sustainable grass growth in all remaining permit areas which <br /> were to be vegetated for final reclamation. Recent photographs show the grass growth, the permit sign <br /> at the entrance on O Street, and one of the permit boundary markers (attached ). <br /> The vegetated areas have been mowed and sprayed to help with grass growth and to control weeds. <br /> Please note that planted and permitted grasses are the primary vegetation on site, but there are some <br /> common weeds, such as Cheat Grass and Field Bindweed, on site. Eradication of these weeds is not <br /> required and not possible, due to their abundance in surrounding properties and road easements. Both <br /> Cheat Grass and Field Bindweed are on Colorado Dept. of Agriculture's (CODA) Noxious Weed List C. <br /> Weld County's Weed Management website notes: "The C list species are out there for Counties and <br /> municipalities to address if they choose to. These species are wide spread throughout the State of <br /> Colorado." Therefore, with sustainable grass growth, and weeds controlled, the final reclamation <br /> requirements for vegetation are now fulfilled. <br /> The property containing the released areas and permitted areas of the Star Water Resource have been <br /> purchased by Varra Companies, Inc. Varra also owns the property and the concrete batch plant to the <br /> north and east of the remaining permitted area. Varra accepts the reclamation "as is" and would like to <br /> have the remaining acres released from the DRMS permit, so that they can start using the entire Star <br /> site for its approved beneficial end uses. Two affidavits, signed by Varra Companies are attached": <br /> (1) Source of Legal Right to Enter, (2) Acceptance of Reclamation As Is. <br /> After reviewing this Full Release Request letter and attachments, please contact me if you need more <br /> information and/or to schedule a release inspection of Star Water Resource.
