Everist, Incorporated (Perm ittee/O pe rator) respectfully requests full release of the permit and <br /> financial warranty covering the Star Water Resource, M-1977-522. Please see the Division of <br /> Reclamation, Mining and Safety's (DRMS) form, Request for Full or Partial Release of Permit <br /> Area/Surety Reduction (attached'). <br /> The remaining permit area is just 20.1 acres and includes the areas consisting of the East Lake, with a <br /> 50-foot setback surrounding the East Lake, the land south of the East Lake, the east part of the parking <br /> area in the south-middle section of the site, and the access road to reach these areas. For complete <br /> boundary details, please refer to Star Water Resource's Release Request Map (2020), which shows <br /> the remaining permit area outlined in green (attached ). <br /> The only remaining reclamation requirements for the permit area were to address the water <br /> augmentation on the post-1981 open water on the East Lake and re-vegetation of areas surrounding <br /> the East Lake. Both requirements have been met for final reclamation and release. <br /> The unlined East Lake has a total of 8.3 acres of open water surface. When L.G. Everist originally took <br /> over the permit for the Star site, the pre-1981 open water surface was assumed to be 6.1 acres. When <br /> we requested release in 2017, the Division of Water Resources (DWR) objected to release of the East <br /> Lake due to the alleged 2.2 acres of post-1981 open water surface of the East Lake. DWR required <br /> water replacement of any evaporative losses associated with the exposure of 2.2 acres of post-1981 <br /> open water surface. We looked at options to achieve a final reclamation solution, including looking for <br /> permanent water augmentation, or backfilling the East Lake to reduce the open water surface. <br /> However, through exhaustive historical research we discovered that our first assumption on the pre- <br /> 1981 East Lake size had been incorrect. The pre-1981 open water surface was over 11.50 acres, not <br /> the 6.1 acres we had incorrectly assumed. Therefore, the total 8.3 acres of open water surface of the <br /> East Lake is considered pre-1981, so water augmentation is not required. <br /> We sent these findings to the DWR, and in September, 2019, they agreed. In October, 2019, we <br /> emailed you a copy of DWR's Re-Evaluation and Approval letter(dated September-03-2019, copy <br /> attached'for reference). The DWR approved the re-evaluation and accepted that 11.50 acres of open <br /> water surface of the East Lake can be considered pre-1981, so all the open water surface of the East <br /> Lake is exempt from evaporative loss replacement requirements. <br /> STAR-DRMS-FullReleaseRequest-July202O Sent via Certified Mail 7016-1370-0001-0670-4393 <br />
