topsoiled and reseeded. <br />The Pond 012 watershed area was originally part of the SL4 bond release request; however, during <br />the adequacy review of the SL4 bond release application, the Division determined that this area was <br />not eligible for Phase I bond release. In early July 2012, a major rainfall event occurred in the Yoast <br />Mine area, resulting in widespread damage to the south mine post -mining drainage channels. The <br />YPM-5-1, YPM-6-2, YPM-6-3 YPM-7, and YPM-7A, drainages and watersheds, all draining to the <br />Pond 012 watershed, required reconstruction and were excluded from the SL4 bond release. <br />The Pond 012 watershed area also included the north inslope of Pond 012, including the Pond 012 <br />slide area. Major landslides have occurred in the Pond 012 slide area on four separate occasions <br />dating back to 2006, and minor slumps and sloughing had been ongoing through 2011. In 2011, SPL <br />completed the regrading and drainage installation portion of the approved slide remediation plan <br />(Technical Revision No. 46). <br />For the Pond 013 Slide Area no reclamation is required, as it has been permitted as a permanent <br />impoundment in its current configuration. Pond 013 was not previously considered for Phase I bond <br />release as it was within the Pond 013 slide area parcel that was required to be observed for at least <br />one year following the 2012 slide activities prior to being eligible for bond release. <br />The locations of all permanent features are delineated on Map 2, Bond Release SL7 Permanent <br />Features Map, in the SU application. <br />Bond Release Parcels <br />The initial SL7 application requested a partial Phase II bond release on 143.3 acres, a partial Phase II <br />and III combined bond release on 41.4 acres and a partial Phase III release on 314.1 acres. DRMS's <br />adequacy review revealed that not all the requested Phase II parcels were sampled properly at the <br />same time the reference areas were sampled for the Phase 11 bond release block. Due to this, and <br />with the exception of parcels 4 and 13, all Phase II requested parcels were subsequently withdrawn <br />from SL7. Parcels 4 and 13 should have been included in the partial Phase III bond release as they <br />were included in the Phase III vegetation sampling conducted. SPL responded to the DRMS <br />adequacy review and clarified acreage discrepancies with the partial Phase TI/TIT requested area and <br />the partial Phase III request area. Based on their response, the SL7 application was updated to <br />include requests of partial combined Phase II/III of 39.4 acres and, a partial Phase III of 315 acres of <br />bond release for parcels as shown in Table 3 below and on Map I. The various changes in acreages <br />are described in the adequacy review response letter provided by SPL dated 18 March 2020, please <br />see that document for details. <br />Bond Release Inspection <br />The SL7 application was deemed complete as submitted. The Division conducted a bond release <br />inspection on 15 October 2019. The site inspection was conducted in accordance with Section <br />3.03.2(2). The Division notified the operator, surface owners, Bureau of Land Management (BLM), <br />the Office of Surface Mining (OSM), and the Water Quality Control Division of the inspection via <br />certified mail.
