Items Approved for Permanent Retention <br />Roads and associated road culverts approved as permanent features for the SPL were approved <br />under Technical Revision No's. 37 and 49 (TR37 and TR49) on 4 December 2008 and 16 <br />September 2010, respectively. Access roads include road(s) A and B (road B becomes road LU - <br />3A). Light use roads include LUI, LU2, MA, LU4, and LU5. The roads approved for <br />permanent retention were deemed necessary to support the post -mining land use and are utilized <br />by property owners for access. <br />The Division approved permanent pond demonstrations for three of the five remaining sediment <br />ponds. Sediment ponds 10, 13, and 14 as well as two small livestock/wildlife stock ponds; Stock <br />Tank 1 and I JA have received approval from the Division to remain as permanent features and, <br />all water bodies receive run off from the SL7 bond release areas. Permanent ponds have met the <br />criteria specified under Rule 4.05.9(13) and were deemed necessary to support the post -mining <br />land use. Ponds 10, and stock tank 1 achieved phase I release in SL4 and constitute approximately <br />0.7 and 0.2 acres respectively that will not be backfilled and graded. Stock Tankl IA (0.2 acres), <br />and its associated drainage and Ponds 13 and 14 comprised part of SL6 partial Phase I bond <br />release and constitute 0.7 acres each, for a total of 1.6 acres which will not undergo backfilling <br />and grading. Pond 014 has been permitted as a permanent impoundment in its current configuration <br />as has Stock Tank 11A. The substation was constructed to provide <br />electricity to the mining equipment and facilities during the mining process. The substation is <br />privately owned by the Yampa Valley Electric Association (YVEA). Both the powerline and <br />substation were retained as permanent features in support of the post -mining land use as part of <br />Technical Revision 37 (TR37). The YVEA powerline corridor (Phase III) was released with <br />SL6 in 2018. The substation pad (Phase I released with SL6) constitutes approximately 0.46 acres <br />and was approved as a permanent feature. <br />The topsoil in Topsoil Stockpile I was to be redistributed on Haul Road B. Since this area was <br />approved for permanent retention, the topsoil in Stockpile I was not needed for reclamation. <br />The topography of the existing topsoil stockpile is consistent with the approved post -mining <br />topography. <br />The Pond 012 watershed area includes a portion of the South Pit and the Neck Pit mining areas. <br />These areas were to be graded to approximate original contour, as depicted in the approved Exhibit <br />20-2 of the Permit Application Package (PAP), their drainages reestablished, and the areas were to be <br />Permit Number C-1994-082 Page 4 of 23 <br />
