PERMIT#: M-1996-076 <br /> INSPECTOR'S INITIALS: ACY <br /> INSPECTION DATE: June 1,2020 <br /> INSPECTION TOPIC: Gen. Compliance With Mine Plan <br /> POSSIBLE VIOLATION: Installation of water conveyance structures within the permit area is not an approved <br /> condition of the permit. This is cited as a possible violation pursuant to C.R.S. 34-32.5-124(1), for failure to <br /> comply with the conditions of an order, permit or regulation. <br /> CORRECTIVE ACTIONS: A Reason to Believe a Violation Exists (RTB) and Notice for Hearing will be sent under a <br /> separate cover for the Possible Violation cited above. <br /> CORRECTIVE ACTION DUE DATE: Immediately <br /> INSPECTION TOPIC: Revegetation <br /> PROBLEM: The current reclamation plan needs to be updated and clarified to address the removal of the water <br /> conveyance system in the middle field and is cited as a problem pursuant to C.R.S. 34-32.5-116 (1). <br /> CORRECTIVE ACTIONS: The operator shall submit a Technical Revision, with the required $216 revision fee, to <br /> update and clarify the current approved reclamation plan to reflect existing and proposed activities. Provide a <br /> detailed map of all water conveyance infrastructure located within the permit boundary and a narrative which <br /> states the size of pipe, linear feet installed and the depth at which it was placed by the corrective action date. <br /> CORRECTIVE ACTION DUE DATE: 7/17/20 <br /> INSPECTION TOPIC: Revegetation <br /> PROBLEM: Per TR-3 the Operator made a commitment to coordinate with Mesa County Noxious Weed and Pest <br /> to develop a weed control plan and submit that plan to the Division by June 1, 2020. The Division has not <br /> received a noxious weed management plan, nor has Mesa County Noxious Weed and Pest been contacted. <br /> This is a problem for failure to follow the approved mining/reclamation plans and failure to employ weed <br /> control methods for state listed noxious weed species within the permitted area, and to reduce the spread of <br /> weeds to nearby areas as required by Section 3.1.10 (6) of the rule. <br /> CORRECTIVE ACTIONS: The operator shall develop a weed control and management plan in accordance with <br /> Section 3.1.10 (6) of the Rule. This plan should be developed in consultation with the county extension agency, <br /> or weed control district office and should include specific control measures to be applied, a schedule for when <br /> control measures will be applied and a post-treatment monitoring plan. This weed control plan shall be <br /> submitted to the Division as a Technical Revision request with the appropriate Technical Revision fee of$216.00 <br /> by the corrective action date. <br /> CORRECTIVE ACTION DUE DATE: 7/17/20 <br /> OBSERVATIONS <br /> This inspection was conducted by the Colorado Division of Reclamation, Mining and Safety (Division). The <br /> Western Slope Flagstone Quarry No. 2 is a 112c permitted site that includes a total of 141.2 acres with a <br /> maximum disturbance of 22 acres. It is located approximately three miles northeast of Palisade, Colorado and <br /> can be accessed from I-70 or Rapid Creek Road. <br /> This report is for inspections conducted by the Division on June 1, 2020 and June 8, 2020. Amy Yeldell (ACY) <br /> and Lucas West (LJW) of the Division conducted the inspections. Inspection narratives are listed in order by <br /> date. Dated photos are also included at the end of the report for illustrative and comparison purposes. <br /> Board Order MV-2019-023 effective September 26, 2019 had three corrective actions; <br /> Corrective Action 1: The Operator shall submit a written plan and gain approval for the removal of all <br /> Page 3 of 22 <br />
