PERMIT#: M-1996-076 <br /> INSPECTOR'S INITIALS: ACY <br /> INSPECTION DATE: June 1,2020 <br /> The followinp, inspection topics were identified as having Problems or Possible Violations. OPERATORS <br /> SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br /> WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br /> Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br /> Reclamation Board will consider possible enforcement action. <br /> INSPECTION TOPIC: Acid And Toxic Materials <br /> PROBLEM: A hydrocarbon spill has occurred at the site which has impacted soils, surface water or groundwater. <br /> CORRECTIVE ACTIONS: The operator shall immediately remediate the spill and submit a final report to the <br /> Division containing at least the following information: <br /> 1) A description of how the spill was cleaned up containing at a minimum - the appropriate maps, volumes <br /> removed, and photo documentation. <br /> 2) Evidence in the form of a receipt that the contaminated soil was disposed of by an approved method (such as <br /> sent to an approved landfill, recycling center, etc.). <br /> CORRECTIVE ACTION DUE DATE: Immediately <br /> INSPECTION TOPIC: Financial Warranty <br /> POSSIBLE VIOLATION: The financial warranty is not adequate to reclaim the site in accordance with the <br /> approved reclamation plan. This is cited as a Possible Violation, of C.R.S. 34-32.5-117(4)(c)(II) and C.R.S. 34- <br /> 32.5-124, for failure to adjust the Financial Warranty within 60 days of notice. And for failure to comply with <br /> Corrective Action 3 of Board Order MV-2019-023 which required the Financial Warranty increase to be posted <br /> by August 21, 2019. <br /> CORRECTIVE ACTIONS: A Reason to Believe a Violation Exists (RTB) and Notice for Hearing will be sent under a <br /> separate cover for the Possible Violation cited above. <br /> CORRECTIVE ACTION DUE DATE: Immediately <br /> INSPECTION TOPIC: Hydrologic Balance <br /> POSSIBLE VIOLATION: At the time of the inspection areas of middle field within the permit boundary were <br /> actively being Irrigated. This is cited-as a possible violation for failure to comply with a Board Order (MV-2019- <br /> 023) as well as conditions of the permit pursuant to C.R.S. 34-32.5-124(1). Water applications within the permit <br /> boundary are not permitted unless specifically for dust suppression and applied via truck. <br /> CORRECTIVE ACTIONS: A Reason to Believe a Violation Exists (RTB) and Notice for Hearing will be sent under a <br /> separate cover for the Possible Violation cited above. <br /> CORRECTIVE ACTION DUE DATE: Immediately <br /> INSPECTION TOPIC: Gen. Compliance With Mine Plan <br /> POSSIBLE VIOLATION: No revegetation of lands affected by the water conveyance system has occurred. This is <br /> cited as a Possible Violation for failure to comply with the conditions of an order, pursuant to C.R.S. 34-32.5- <br /> 124(1), The Board Order MV-2019-023 Corrective Action 2 required that by November 1, 2019, that all lands <br /> within the permit boundary, affected by the water conveyance system must be reseed with the seed mix in the <br /> approved reclamation plan. <br /> CORRECTIVE ACTIONS: A Reason to Believe a Violation Exists (RTB) and Notice for Hearing will be sent under a <br /> separate cover for the Possible Violation cited above. <br /> CORRECTIVE ACTION DUE DATE: Immediately <br /> Page 2 of 22 <br />
