In the 2002 amendment Reclamation Timetable has an <br /> end use as "Roads, Ind., Comm, & rip rap" no revegetation needed. Stage Z is zoned <br /> Industrial but the state permit maps show it as C-WM but as listed in the 2002 <br /> Reclamation Timetable under end use "Roads, Ind., Comm, & rip rap" - no revegetation <br /> needed. The Reclamation Plan in 2002 called for the area to be used for Commercial or <br /> Industrial purposes, so the reclamation needed has not changed other than now this Stage <br /> has a Concrete Plant on it, an allowed use in an Industrial Zone district. <br /> The zoning was changed on both Stages in 2006 to Industrial to allow for the Concrete <br /> Plant and designated Stage X as an Industrial zoned area instead of a use in the P.D. Then <br /> in 2008 the stages were removed from the P.D. In 2011, the single lot was split into two <br /> Industrial lots. This split allowed Clear Creek County to purchase Stage X and leave Stage <br /> Z as a standalone parcel. Reclamation to a graded area for Stage X was done, until 2019 <br /> when the County let CDOT use it as a material storage and staging area for I-70 <br /> Westbound PPSL construction. The landowner is using it for Industrial purposes so it <br /> meets the definition of the correct end use. The current uses are consistent with the end <br /> uses approved in 2002 by the MLRB so release should be done without having to amend <br /> the current permit. <br /> I have attached copies of the 2006 Clear Creek County Board of Commissioners Resolution <br /> #06-128 that removed the two stages from the P.D. and the Exception By Resolution that <br /> divided the parcel into 2 lots. Stage X became Lot 1 and Stage Z became Lot 2. Then <br /> Clear Creek County became the owners of Lot 1 (Stage X). <br />
