Bond Release No. 9, SL -09, was approved on August 17, 2018. Phase I, Parcels 33 and 34. <br />19.39 acres. Phase I liability release of $16,418.87. <br />SL -10 submitted July 1, 2019 the application was found complete on August 28, 2019. SL -10 <br />requests phase II bond release on Parcels 31, 32 and 33, in the reclaimed B -Pit area. CEC is <br />requesting Phase II bond release on 29.82 acres, and are requesting release of $74,247.63 of <br />reclamation liability. The bond release inspection was conducted on September 26, 2019. <br />Participants at the bond release inspection included Coors Energy company representatives, <br />Danny Kipp and Ben Moline, Tom Medlin of the U.S. Office of Surface Mining reclamation and <br />Enforcement (OSM), and Janet Binns of Colorado Division of Reclamation, Safety and Mining. <br />The site inspection was conducted in accordance with Rule 3.03.2(2). <br />No comments, written objections, or requests for an informal conference regarding the bond <br />release application were received by the Division. <br />II. CRITERIA AND SCHEDULE FOR BOND RELEASE <br />PHASE I <br />Rule 3.03.1(2)(a) states, "Up to sixty percent of the applicable bond amount shall be released when the <br />permittee successfully completes backfilling, regrading, and drainage control in accordance with the <br />approved reclamation plan." With regard to Phase I bond release, the approved reclamation plan for the <br />Keenesburg Strip Mine calls for <br />Phase I criteria were not requested or evaluated for this bond release application. All parcels requested <br />for Phase II bond release in SL -10 have previously been approved for Phase I bond release. <br />PHASE II <br />Rule 3.03.1(2)(b) states, "Up to eighty-five percent of the applicable bond amount shall be released upon <br />the establishment of vegetation which supports the approved post -mining land use and which meets the <br />approved success standard for cover... based on statistically valid data collected during a single year of the <br />liability period". In regard to Phase II bond release, Rule 3.03.2(3)(b) also states, " No more than sixty <br />(60) percent of the bond shall be released so long as the lands to which the release would be applicable are <br />contributing suspended solids to streamflow or runoff outside the permit area in excess of pre -mining <br />levels as determined by baseline data or in excess of levels determined on adjacent non -mined areas". <br />Phase II bond release, the approved reclamation plan calls for replacement topsoil (topsand) of 24 inches. <br />Vegetative cover success is determined by factoring the previous 11 months (September through July) <br />precipitation data into an approved predictive formula to determine successful vegetative over. The post - <br />mining land use is rangeland with industrial use in designated areas.
