for a partial Phase III bond release for the 162.1 acre bond release block as per Table 3 below. This proposed decision will release the applicant from Phase III reclamation liability for those SL20 bond release parcels totaling 162.1 as shown in Table 2. With the approval of the SL19 application the remaining reclamation liability was $21,222,905.74. Upon approval of TR124 the total required surety was increased by $8,106,155.00 for an additional 201.4 acres of affected land. For the SL20 cost calculation, DRMS had to take into account the resultant increase in the worst case scenario liability amount with the $8,106,155.00 cost increase from TR124. This yields a required surety deficit of $420,885.55 ($29,749,946.29 (-) $29,329,060.74). Using the TR124 Resultant Cost Total as the baseline liability amount, DRMS calculated the reduction in liability associated with the proposed approval of 162.1 acres for Phase III bond release proposed with SL20.
