expires, Uintah Mining will give Grantor 60-day notice and terminate the agreement, <br /> leaving the pump, power supply and water line in place. <br /> 10. Acceptance of Premises. No representations, except such as are contained <br /> herein or endorsed herein, have been made to Grantee respecting condition of said <br /> premises and the taking possession of said premises by Grantee shall be conclusive <br /> evidence against Grantee that premises were in good and satisfactory condition when <br /> possession of the same was so taken. Grantee shall, at the termination of this lease <br /> by the expiration of time or otherwise, surrender and deliver up premises to Grantor <br /> in as good condition as when received by Grantee or as thereafter improved by <br /> Grantor, reasonable use, and wear and damages by fire or other casualty excepted. <br /> 11. Entry and Inspection. Grantor or its legal representatives shall have free access <br /> to the premises hereby leased during usual business hours for the purpose of <br /> examining or exhibiting the same or the make needed repairs or alterations of said <br /> premises that Grantor may say fit to make. <br /> 12. Accidents and Indemnity by Grantee. Grantee shall defend and indemnify <br /> Grantor and save it harmless from and against any and all liability, damages, costs or <br /> expenses, including attorneys' fees, on account of injuries to the person or property <br /> of Grantor or any other tenant or other person rightfully on the property where such <br /> injuries are caused by the negligence or misconduct of Grantee, or its officers, <br /> agents, servants, or employees in or about the premises, provided that the foregoing <br /> provision shall not be construed to make Grantee responsible for loss, damage, <br /> liability or expense, or portion thereof, on account of such injuries caused by the <br /> negligence or misconduct of Grantor or any persons other than Grantee, its officers, <br /> agents, servants, or employees. <br /> 13. Insurance. <br /> (a) Insurance Coverage of Premises. Grantee shall, at all times during the term <br /> of this lease and at Grantee's sole expense, keep all improvements which are now or <br /> hereafter a part of the premises insured against loss or damage by fire and the <br /> 4 <br />
