This release request is for a total of 1.485 acres that have been fenced off for <br /> parking, drainage, and trail easements granted to the City of Loveland. The revised <br /> permit area as proposed leaves a total of 255.55 acres remaining in the mining permit <br /> boundary. N <br /> Loveland Ready Mix Concrete, Inc. (LRM) is also submitting a formal Request for a <br /> Technical Revision to the Permit,thereby reducing the Division's March 24, 2020 <br /> increase in the Financial Warranty. <br /> Attached are two versions of the revised Exhibit C-1 and the revised Exhibit F-1 <br /> showing the 1.485 acres to be removed from the east mining permit boundary. This <br /> area was fenced off by the City of Loveland when they installed a parking lot, a <br /> drainage swale, and pedestrian trail in early 2019. It is easily identifiable and public <br /> access is allowed to this area so it is appropriate to remove it from the mining <br /> boundary. <br /> After careful review of the Division's inspection report dated February 20, 2020, and <br /> the follow up letter from the Division dated March 24, 2020, LRM believes this <br /> Technical Revision provides for minor changes to the Reclamation Plan that reflect the <br /> maturity of the site and current "as-built" conditions.These as-built conditions meet <br /> the spirit of the original Reclamation Plan. <br /> Referencing paragraph 6.4.5 (1) from the Mineral Rules and Regulations for the <br /> Extraction of Construction Materials : "Operators/Applicants are encouraged to allow <br /> flexibility in their(reclamation) plans by committing themselves to ranges of numbers <br /> rather than specific figures." <br />
