Permit No. M-1992-009 <br /> Dear Mr. Russell: <br /> On behalf of Mr. Chris Pyles, owner and operator of the Gillette Sand and Gravel Mine (the mine), <br /> Realtime Aquifer Services (RAS, Inc.) has prepared the attached Technical Revision JR) to Exhibit <br /> D of Permit No. M-1992-009. A check to cover the filing fee of $216.00 for this submittal was <br /> mailed to your office on April 7, 2020. <br /> The objective of the TR is to return the Gillette Mine to compliance and to have the Cease and Desist <br /> Order lifted (Board Order MV-2019-033), while protecting the environment through the use of sound <br /> engineering and work practices. This TR is an alternative to the Board-stipulated annexation of the <br /> adjacent 4.08-acre tract of land to the west. Attempts to acquire access to that land reached an <br /> unresolvable impasse. This TR is intended as an equivalent alternative to the Board's Order. <br /> The TR describes changes to mitigate potential future off-site releases, including relocation of the <br /> sedimentation ponds to add a 30-foot buffer area, with secondary containment, along the western <br /> margin of the Permit Area. The process ponds will be reconstructed to improve access and <br /> serviceability and to prevent potential releases from occurring. In addition, pond levels and sediment <br /> accumulation will be formally monitored as part of the process. <br /> There is no increase in the affected acreage or area of disturbance of the Mined Land Reclamation <br /> Permit (M-1992-009) and changes are all within the affected Mined Land Reclamation Permit <br /> boundary. There is no substantive change in the approved Mined Land Reclamation Permit, or any <br /> change in the approved post-mining use. There are no additional demands on Teller County services <br /> or infrastructure, and changes proposed by the TR will not impact adjoining land uses. <br /> The proposed TR will provide permanent, robust corrective measures and workable solutions to the <br /> compliance issues cited at the mine without decreasing mine productivity.
