Mr. O'Brian—Environment Inc. <br /> March 27 <br /> Page 3 of 6 <br /> The first paragraph of the"reclamation plan for backfill areas" contains some incomplete sentences/thoughts. <br /> Please revise as needed. <br /> If backfilled areas are not returned to approximate original grade,reclamation slopes must be able to be traversed <br /> by agricultural equipment to support post mining land use of cropland as described—please acknowledge. <br /> If backfill areas are modified from cropland to be reclaimed as"wetland or wetland bank areas", a TR must be <br /> submitted as described, and a permanent augmentation plan for exposed groundwater will need to be approved by <br /> the State Engineer's Office Division of Water Resources before those areas will be able to be released from the <br /> DRMS permit.Please acknowledge. <br /> Post mining revegetation will need to be established and largely weed-free prior to release of an area from the <br /> DBMS permit. No"reasonable assurance"exceptions as described in the permit application will be made. Please <br /> plan accordingly. <br /> The permittee is responsible to DRMS for maintaining the entire permit area in compliance with all applicable <br /> rules and requirements,including weed control within the permit area. Any outside agreements between the <br /> permittee and other parties for site use and/or maintenance will be the permittee's responsibility to enforce. <br /> EXHIBIT F-Reclamation Plan Map (Rule 6.4.6): What is the fine green line around Phase 4B and on the <br /> north end of Phase IA depicting? <br /> Please show the locations of the required flood inlet/outlet structures in Phases 1 and 2. <br /> The reclamation plan maps state that if the backfilled areas are not reclaimed to approximate original grade for <br /> cropland,they will be backfilled to at least two feet above groundwater and reclaimed as rangeland. The <br /> provision for reclamation as rangeland is not found in the text of the reclamation plan. Please edit as needed for <br /> consistency. <br /> EXHIBIT G-Water Information(Rule 6.4.7): <br /> Rule 3.6.1(1)of the Minerals Rules and Regulations of the Colorado Mined Land Reclamation Board for the <br /> Extraction of Construction Materials states: "Disturbances to the prevailing hydrologic balance of the affected <br /> land and of the surrounding area and to the quantity or quality of water in surface and groundwater systems both <br /> during and after the mining operation and during reclamation shall be minimized..." To address these concerns,a <br /> Groundwater Mitigation Plan was provided by the operator to supplement the required information provided for <br />
