SCOTT
RECEIVED
MAR 2 41020
DIVISION OF RECI.AMATO4
MINING AND SAFETY
March 19, 2020
\\Mr. Lucas West
Colorado Division of Reclamation, Mining and Safety
1313 Sherman Street, Room 215
Denver CO 80203
Re: Response to Comments regarding Construction Materials Regular (112)
Operation Reclamation Permit, Application No. M2020008
Dear Mr. Lucas,
This letter is in response to your recent correspondence, dated March 5, 2020, regarding
comments received by the Colorado Department of Reclamation, Mining and Safety
(DRMS) regarding our recently submitted application for a Construction Materials
Regular (112) Operation Reclamation Permit. We reviewed the concerns raised in each
of the submissions to DRMS, and below have provided responses to each the specific
issues raised in the submissions.
Colorado Parks and Wildlife (CPW)
In its letter, CPW raised several issues, which fall into two categories: (1)
Construction/Operation BMPs, and (2) Reclamation and Future Operations BMPs. Our
response to the issues raised by CPW are also grouped into these two categories.
Construction/Operation BMPs
1. Issue: Impact on Mule Deer and elk in the vicinity - CPW specifically requests
that winter operations are limited to 7:00 A.M. to 5:00 P.M. to avoid excessive
disturbance to these animals.
Response: Scott Contracting will limit its winter operations to the 7:00 A.M. to
5:00 P.M. window.
2. Issue: In order to avoid spread of noxious weeks, CPW requests that all equipment
be sanitized and cleaned upon arrival and exit of the property.
