6. Source: Ground water tributary to the Big Thompson River. <br /> 7. Priority dates: <br /> 7.1 Larimer Pits: July 31, 1979 <br /> 7.2 Mariana Butte Pit: September 29, 1988 <br /> 7.3 Baer Pit: October 16, 1997 <br /> 8. How appropriation was initiated: Mining/construction of the Gravel Pits was occurring <br /> at various times in the 1970's, 1980's and 1990's on or prior to the priority dates above. As <br /> evidenced by its approved reclamation plans and mining permits, LRM had manifested the intent <br /> to appropriate water for its claimed mining, reclamation and other uses as of the priority dates <br /> above. LRM's actions, and on-going mining manifested its intent, gave adequate notice, and <br /> constituted substantial steps toward appropriation of water, all as of the priority dates claimed in <br /> Paragraph 7 above. <br /> 9. Amounts: <br /> 9.1 Larimer Pits: <br /> 9.1.1 Reclamation: As described in Paragraphs 14.2 and 14.3 below. <br /> 9.1.2 Mining and processing of mining products, concrete production and dust <br /> suppression: As described in Paragraph 14.1 below. <br /> 9.2 Mariana Butte Pit Reclamation: As described in Paragraph 14.5 below. <br /> 9.3 Baer Pit Reclamation: As described in Paragraph 14.4 below. <br /> 10. Wells: The unlined pits at the Gravel Pits are '`wells" as defined in C.R.S. § 37-92- <br /> I03(14)(a) and Three Bells Ranch v. Cache la Poudre Water Users Assn., 758 P.2d 164 (Colo. <br /> 1988). The Larimer Pits have well permit number 62009-F. The Baer Pit has well permit <br /> number 051129-F. The Mariana Butte Pit has well permit number 67510-F. The current permits <br /> allow a total of 43.3 acres of exposed surface area. Pursuant to C.R.S. § 37-90-137, a well <br /> permit must be obtained from the State Engineer for any' additional surface area exposure at the <br /> Gravel Pits and well permits shall be issued by the State Engineer upon approval of the plan for <br /> augmentation decreed herein and after LRM submits an application and required filing fee. <br /> 11. The waters claimed have been diverted or otherwise captured, possessed and controlled <br /> and have been applied to beneficial use. <br /> 4 of 14 <br />
