C.R.S. § 37-90-137(11)(b), augmentation plans decreed prior to July 1, 1989 "shall be <br /> given full effect and shall be enforced according to their terms." Therefore, Case No. W- <br /> 7412 continues to govern augmentation of those ponds and use of the Rist& Goss Ditch <br /> water remains governed by the decree in Case No. W-7412. All references below to the <br /> Larimer Pits, the amount of exposed ground water, depletions and augmentation <br /> requirements exclude pits 1, 3, 4, 5, 6, 9 and 1 I which are subject to Case No. W-7412. <br /> 3.3 Prior decrees for augmentation water rights: In Case No. 00CW 143, Loveland <br /> Ready Mix changed the uses of 120 Barnes Ditch contract inches to allow storage and uses, <br /> among others, augmenting depletions from its gravel mining operations at the Gravel Pits. <br /> Conditional storage rights were decreed for Loveland Ready Mix Ponds 1 and 2 (aka Larimer <br /> Pits 16 and 17) in Case No. 98CW43I. The 120 Barnes Ditch contract inches and the storage <br /> rights will provide the augmentation water supply for the augmentation plan decreed herein. <br /> APPROVAL OF WATER RIGHTS <br /> 4. LRM is entitled to a decree for ground water rights for the Gravel Pits as set forth below. <br /> Ground water rights are decreed for the Gravel Pits to establish priorities for the evaporative <br /> depletions and other uses identified in Paragraph 5 below. The augmentation plan decreed <br /> herein is designed to fully replace all out of priority stream depletions caused by the Gravel Pits. <br /> 4.1 Larimer Pits, which includes the lands located within the exterior boundary of <br /> DRMS Permit No. M-1974-069 Am-2, located in portions of Section 15, 16 and 17, T5N, <br /> R69W, 6th P.M., Larimer County, as shown on Exhibit A, but excluding pits 1 through 12, 16, 17 <br /> and 19. <br /> 4.2 Mariana Butte Pit, DRMS Permit No. M-1988-033, located in the SW'/, Section <br /> 16, T5N, R69W, 6th P.M., Larimer County, as shown on Exhibit A. <br /> 4.3 Baer Pit, DRMS Permit No. M-1984-113, located in the NW'/, Section 23, T5N, <br /> R69W, 6th PM, Larimer County,as shown on Exhibit A. <br /> 5. Uses: <br /> 5.1 Larimer Pits: mining and processing of mining products, concrete production, <br /> reclamation, recreation and fish propagation. Mining use includes processing of mining <br /> products, concrete production and dust suppression and is generally described in Paragraph 14.1 <br /> below. Reclamation use is generally described in Paragraphs 14.2 and 14.3 below. <br /> 5.2 Mariana Butte Pit: reclamation, recreation, and fish propagation. Reclamation use <br /> is generally described in Paragraphs 14.2 and 14.5 below. <br /> 5.3 Baer Pit: reclamation, recreation, and fish propagation.
