Section—2.05.4 <br /> The West Valley haul road will be left in place to provide continued public access to the Somerset <br /> Cemetery, and to the raw water and culinary water systems. The Methane Project road will also <br /> remain to provide access to the Upper Elk Creek Pad and the Methane Project. <br /> The historic Somerset Cemetery is retained in its pre-mining condition as an active cemetery. <br /> The Sanborn Creek road and a section of the Elk Creek culvert will be retained to provide continued <br /> access to the area east of Elk Creek and old State Highway 133. Areas adjacent to this road are <br /> retained as transloading,water pipeline,equipment and material storage sites. <br /> The Bear Creek Methane Project Site,the Elk Creek Methane Project,the Sanborn Creek Methane <br /> Project, the Methane Project gas pipeline, and Sanborn Creek Utility area shall remain as <br /> Industrial/Mining postmining land use, as part of the Methane destruction facilities operated by <br /> Vessels Coal Gas, Inc. <br /> The Upper Elk Creek Pad and Methane Project remain as industrial/mining postmining land use. <br /> The Main Facilities,Pond C light use road,East Elk Creek Road,Sanborn Creek Road,and adjacent <br /> areas remain as industrial/mining post/mining land use for facility equipment and materials storage. <br /> The Buildings on the Upper Elk Creek Pad,and Methane Project Buildings remain for use with the <br /> Methane project. <br /> "B Pond"will be retained to collect storm water from the Main Facilities area and backwash water <br /> from the Culinary water system. This pond is located within the Main Facilities industrial/mining <br /> postmining land use area. <br /> The West Elk Mine Loadout facility is retained as industrial/mining postmining land use for this <br /> purposes of this permit. <br /> The Railroad Right of Way corridor within the permit area will remain as industrial/mining <br /> postmining land use. The Oxbow rail siding is 5,888 feet long, more or less, and is located just <br /> north of the mainline. Of this length, 3,443 feet on both ends of the spur is owned by the Union <br /> Pacific Railroad Company, and 2,445 feet of rail, in the interior of the spur, is owned by Oxbow <br /> Mining, LLC. The Oxbow rail siding will remain for Union Pacific Railroad Company and <br /> Gunnison Energy, LLC Rail Activities. <br /> OMLLC will work with the responsible land management agencies to develop and execute any <br /> necessary easement agreements required for long-term access and maintenance. <br /> The utility, capacity, and potential for reclaimed lands to support alternative uses is limited by <br /> distance from established population centers,the rugged terrain of the area,and a semi-arid climate <br /> that limits agricultural activity. However, OMLLC continues to pursue alternative use <br /> opportunities for its property during this reclamation/bond release period. Such alternatives include <br /> continued Methane destruction projects, continued Office rentals, and continued Natural gas <br /> company support. Other such alternative uses may consist of rural, vacation, or retirement home <br /> development because of the proximity to the culinary water system. <br /> TR-78 2.05-70a Revised Feb. 2020 <br />
