Section—2.05.4 <br /> Protection, and health and safety standards. Specific compliance control and monitoring practices are <br /> identified and discussed in Sections 2.05.3, Operation Plan— Permit Area, and 2.05.4, Reclamation Plan. <br /> In addition, OMI has obtained and maintains ongoing compliance with required air quality permits <br /> administered by the Colorado Department of Public Health and Environment — Air Pollution Control <br /> Division, water quality permits administered by the Colorado Department of Public Health and <br /> Environment—Water Quality Control Division, mine health and safety approvals under the Federal Mine <br /> Safety and Health Administration,and a number of other Federal, State, and local permits and approvals. <br /> A full listing of existing approved permits is provided in Section 2.03.10, Identification of Other Licenses <br /> and Permits,and current copies of these other permits are provided in Exhibit 2.03-E4,Other Permits. OMI <br /> has maintained an effective record of permit compliance during their management and operation of the <br /> Oxbow mining operations. To date, there have been no major violations of any mine environmental or <br /> health and safety standards under OMI's operation and there have been no minor violations within the past <br /> three years as documented in Section 2.03.5, Compliance Information. <br /> 2.05.5 -Postmining Land Use <br /> OMLLC proposes to return surface areas disturbed by mining and related activities to a postmining land <br /> use of undeveloped lands utilized for very limited grazing and dispersed wildlife habitat and recreational <br /> uses with the potential for industrial/mining operations installations adjacent to the existing highway <br /> corridor and in remaining areas of the OMLLC property. The proposed postmining land use is consistent <br /> with both the premining condition and land use as described in Section 2.04.3, Site Description and Land <br /> Use Information and Gunnison County land use designations (for those areas within Gunnison County). <br /> Delta County has not adopted formalized zoning or land use designations. Restoration of disturbed lands <br /> consistent with the proposed postmining land has been and will continue to be accomplished through <br /> application of the reclamation methods,techniques,and activities identified and described in Section 2.05.4, <br /> Reclamation Plan, and detailed and illustrated in both the Postmining Topography and Land Use Maps, <br /> (Maps 2.05-M6 through 2.05M-8), and Exhibit 2.05-E5, Reclamation Details. Areas that are either <br /> currently disturbed or will be disturbed in the future that will be reclaimed and returned to the proposed <br /> postmining land use are owned or controlled by either OMLLC or the United Stated as indicated by the <br /> Surface Ownership Map, (Map 2.03-M1). Consistent with and in support of the proposed postmining land <br /> use,the following developed features will be retained or established during site reclamation. <br /> Portions of the Bear Creek Facilities area, and the Lower Hubbard Creek Facilities area have been <br /> reclaimed and returned to undeveloped/public use consistent with the objective of maintaining <br /> access to adjacent public lands. <br /> Segments of Bear Creek Canyon, Lower Hubbard Creek, and Upper Hubbard Creek roads and <br /> associated culverts are retained for landowner and public access. <br /> The Upper Hubbard Creek Facilities area is reclaimed as a parking lot and trailhead to provide <br /> access to adjacent U.S. Forest Service Lands. (Landowner and public access post mining use) <br /> The Hubbard Creek Fansite culvert and creek crossing remain in place to provide landowner and <br /> public access. <br /> The existing potable water supply treatment,storage and delivery system,intake water pump house, <br /> intake gallery and associated infrastructure and buildings will be retained as industrial/mining <br /> postmining land use,to continue to supply domestic water to the town of Somerset. <br /> TR-78 2.05-70 Revised Feb. 2020 <br />
