pCOLORADO <br /> Division of Reclamation, <br /> Mining and Safety <br /> Department of Natural Resources <br /> 1313 Sherman Street, Room 215 <br /> Denver, Colorado 80203 <br /> February 21,2020 <br /> Mr. Ray Thomas <br /> RWT Excavating and Demolition LLC <br /> 3771 Road P <br /> Wiggins,CO 80654 <br /> Re: Thomas Gravel Pit#4,Permit M1981-286,Notice of Upcoming Financial Warranty Increase, Revision <br /> SI01 <br /> Mr.Thomas: <br /> Based on observations made on the site inspection on January 23,2020,and existing permit reclamation <br /> requirements, DRMS has recalculated the required Financial Warranty for this permit in accordance with Rule 4.2.1 <br /> of the Rules and Regulations. The new warranty amount required is$154,000. This is an increase of$129,000. As <br /> noted in the inspection report,this surety increase is based on existing site conditions,and reflects the increased <br /> reclamation costs that would be incurred by the State since the reclamation bond was first calculated in 2010. <br /> It should also be noted that a Technical Revision to the mining plan will also need to be submitted to the Division to, <br /> at a minimum,modify the existing 10 acre maximum allowed disturbance. During the inspection on January 23,2020 <br /> it was noted that approximately 52 acres have been disturbed at this time. The increase from 10 acres to 52 acres of <br /> disturbed area accounts for the majority of the required surety increase. <br /> A cost summary for the proposed increase is attached to this letter for you to review. Any questions regarding the <br /> Division's bond estimate and/or evidence demonstrating that reclamation work has been completed which may <br /> impact the required bond(including photos and a detailed description of work completed)shall be submitted to the <br /> Division within 30 days of the date of this letter. <br /> 30 days from the date of this letter(March 26,2020)the Division will formally issue the Surety Increase. Within 60 <br /> days from the date of the Surety Increase letter,the Division ordered amendment of the current Financial Warranty,or <br /> submittal of a new Financial Warranty reflecting the required increase,will be due.
