On Figure 3,page D-6, the cross-section of the Processing Area Berm indicates the <br /> height of the berm to be greater than 9 feet. Please clam if the berm will be greater than <br /> 9 feet, and if so what is the estimated height of the berm. The Applicant should be aware <br /> if the berm exceeds 10 feet in height it may be considered a Jurisdictional Dam and <br /> subject the authority of the State Engineer. <br /> The Processing Area Berm will be less than or equal to 9 feet in height,the previous Figure 3 <br /> included a typographical error.
