14. The Applicant indicates portable concrete and asphalt batch plants with associated tanks <br /> will be located within the permit boundary. Please provide the Division with proof of the <br /> appropriate Huerfano County zoning or special use permit allowing the asphalt and/or <br /> concrete plants, the required Air Pollutant Emission Notice (APEN9 permit from the <br /> Colorado Department of Public Health and Environment and all other applicable <br /> permits to operate the asphalt and/or concrete plants at the site or commit to submitting <br /> a technical revision to the permit pursuant to Rule 1.9 prior to operating the asphalt <br /> and/or concrete plants. <br /> APEN permits for the portable asphalt and concrete plants will be provided to the Division <br /> following the start of operations but prior to the start of mining as well as before either plant is in <br /> use on the site. The Huerfano County CUP #00-060 does not address asphalt and concrete batch <br /> plants; however, project specific portable batch plants are permitted via regulation `1.12.01 <br /> Temporary Building and Uses Approved by Staff in the Huerfano County Zoning and <br /> Regulations. This regulation reads: <br /> "Upon application to the Huerfano County Code Enforcement Officer a temporary use <br /> permit may be issued for the following uses, as shown in Table 3, below, in the following <br /> zoning districts and for the following periods of time. Such permits shall be valid only for <br /> the period of time specified and no more than two renewals of the temporary permit shall <br /> be issued by the County Code Enforcement Officer. " <br /> Therefore, an application for temporary asphalt and concrete plants will be filed with the <br /> Huerfano County Code Enforcement Officer for project based temporary use of portable plants. <br /> Approval of such applications will be submitted to the Division prior to use of concrete and <br /> asphalt plants on site. <br /> 15. Please provide a typical cross-section of the proposed catch ditches on the final <br /> reclaimed dumps slopes. <br /> A typical cross-section of the proposed catch ditches is shown in Exhibit D as Figure 4, page D- <br /> 11. This figure details both construction slopes as well as reclamation slopes of the dump. <br /> 16. Please provide cross-sectional details of the embankment/berm structures of the <br /> ponds/sumps that are proposed. <br /> A typical cross-section of the berm within the processing area as well as the berm at the toe of <br /> the dump is shown as Figure 3 on page D-6 and Figure 5 on page D-12. <br /> 17. Please provide any details regarding any outlet structures and/or spillways for the <br /> ponds/sumps. <br /> Bradford Mesa—Preliminary Adequacy Response 5 <br />
