Map C-2 Mine Plan details mineral ownership by phase. A lease is in process with the BLM and <br /> all BLM split-estate mineral phases will be mined later in the mine's life. Prior to mining in the <br /> BLM split-estate mineral phases, a TR will be submitted to the Division which includes the <br /> executed BLM mineral lease. This is also shown in Exhibit M and Exhibit O. <br /> 3. Please provide an updated maps that shows the proposed locations) of the topsoil and <br /> overburden stockpiles for the phases to show that they will be re-handled as little as <br /> possible pursuant to Rule 3.1.9(3). <br /> All maps (C-1, C-2, C-3, and F-1) are updated to show the location of topsoil and overburden <br /> stockpiles throughout the site during mining and in final reclamation. Stockpiles recovered as the <br /> result of opening Phase 1 will be stored in the processing area and will be used to provide <br /> sediment control for the processing area. Overburden from Phase 1 and/or the processing area <br /> will be used to build-up the processing area sediment control structure and will be topped with <br /> topsoil from Phase 1 and/or the processing area. Each subsequent phase's recovered materials <br /> will be used to reclaim the previously mined strip within the adjacent phase and will not be <br /> stockpiled. Natural drainages from unmined portions of the mesa will be diverted around the <br /> mining and processing areas either through drainage ditch relocations or construction of two- <br /> foot-tall isolation berms. These details are included on pages D-19, D-20, and G-1 as well as in <br /> Figure 3. <br /> 4. Please provide updated maps that show the proposed location(s) of the imported material <br /> stockpiles. <br /> All maps (C-1, C-2, C-3, and F-1) are updated to show the location of imported materials <br /> stockpiles throughout the site during mining. <br /> Exhibit D—Mining Plan (Rule 6.4.4) <br /> 5. Please describe how the mining will proceed to maintain the conditions of the currently <br /> approved CUP. <br /> The Huerfano County CUP includes an additional —300 acres to the north of the DRMS <br /> permit boundary to include the full Colorado State Land Board section and will not be <br /> mined as the basalt resource is not located in that area of the Colorado State Land Board <br /> parcel. The DBMS permit includes an additional —200 acres to the south from the CUP, <br /> these additional acres will remain unaffected by mining and are shown as such on Map C- <br /> 2. While both permits include different acreage, no mining will occur outside of the <br /> overlapping permit boundary area as shown on Map C-2. In the event that mining outside <br /> of the Huerfano County CUP area becomes planned, an amendment to the CUP will be <br /> required and secured prior to any ground disturbance. A TR will be submitted to the <br /> Division to include additional phases in the event that mining becomes planned south of <br /> the current CUP 00-060 boundary. In other words, NO mining will occur outside the <br /> Huerfano County CUP boundary unless and until an amendment is approved granting <br /> mining within acres outside the current CUP boundary as detailed in CUP 00-060.
