ACU REN <br /> EXECUTIVE SUMMARY <br /> In June of 2011, Acuren Inspection performed a formal external inspection on 21 storage tanks <br /> at Cripple Creek and Victor mining facility. The inspection was performed, in accordance with the <br /> guidelines of ST-SP001, API 12f, UL-142, and Acurens Equipment inspection procedures EIP-03, <br /> Rev 7 and UT-2 Rev. 10. <br /> Acuren utilized ultrasonic thickness testing, and visual testing to assess the condition of the tank. <br /> Ultrasonic thickness readings were taken on the shell, nozzles, roof and floor where accessible. <br /> The visual inspection was performed using the checklist found in STI-SP001 and noting any out <br /> of tolerance conditions and concerns. <br /> The following report includes findings, recommendations, inspection data and technique records <br /> of the tests and inspections performed. Drawings and pictures are used to illustrate data <br /> collection points and defect areas. Acuren inspection final reports have no intent or represent in <br /> any form an Engineering Evaluation of the serviceability of the tank or piping structure. The <br /> Client, Owner and Operator has final acceptance of inspection data submitted under this <br /> contract. <br /> SCOPE OF SERVICE The agreement of Acuren to perform services extends only to those <br /> services provided for in writing. Under no circumstances shall such services extend beyond the <br /> performance of the requested inspection of specific equipment PROVIDED FOR IN WRITING and <br /> the preparation of repots or similar documents reflection the inspection data obtained or the <br /> opinion formulated on the basis of such inspection. It is expressly understood that all <br /> descriptions, comments and expressions of opinion reflect the opinion or observations of the <br /> examiner and are not intended, nor can they be construed, as responsibilities of the <br /> owner/operator and the owner/operator retains complete responsibility for the engineering, <br /> repair and use decisions as a result of the inspection data or other information provided by <br /> Acuren. In no event shall Acuren's liability in respect of the services referred to herein exceed <br /> the amount paid for such services. <br /> STANDARD OF CARE <br /> In performing the services provided, Acuren uses the degree of care and skill ordinarily exercised <br /> under similar circumstances by others performing such services in the same or similar locality. <br /> No other warranty, expressed or implied, in made or intended by Acuren. <br /> LIMITATIONS OF LIABILITY <br /> Nothing in this agreement shall be construed to mean that Acuren assumes any liability on <br /> account of injury to persons or property, including death, except those directly caused by <br /> negligent acts of Acuren or its employees and that purchaser's property or equipment is in no <br /> way affected by this agreement. Acuren shall not be held responsible or liable for any loss, <br /> damage, detention or delay caused by accidents, strikes, lack outs, fire, flood, acts of civil or <br /> military authorities, or by insurrection or riot, or by any other cause that is unavoidable or <br /> beyond Acuren's control or in any event for consequential damages including, without limitation, <br /> downtime or loss of use. <br />
