ResponseSpill and <br /> CountermeasuresNEWMONT .r the Cresson Project <br /> Sustainability& External Relations <br /> 1 GENERAL INFORMATION <br /> 1.1 Purpose <br /> The purpose of this combined Spill Response Plan (SRP)and Spill Prevention, Control and Countermeasures(SPCC) <br /> Plan (The Plan) is to describe the measures implemented by Cripple Creek&Victor Gold Mining Company(CC&V) <br /> to prevent oil discharges from occurring at the Cresson Project Operations located in the Cripple Creek Mining <br /> District of Colorado,and to prepare CC&V Team Members(all employees)of CC&V to respond in a safe, effective <br /> and timely manner to mitigate the impacts of a discharge.Additionally,this Plan is to provide guidance to protect <br /> water quality through containment of potential soil and water contaminants.The Plan assesses the potential for <br /> contaminant releases,describes the controls to prevent contaminant releases,and provides instruction for <br /> responding to contaminant releases. Federal and State Reportable Quantities(RQs)are used to determine agency <br /> reporting and remediation requirements as appropriate.This Plan is a combined plan that serves as both CC&V's <br /> SPCC Plan and SRP. <br /> The procedures and policies described herein apply to the activities of all CC&V Team Members and to other <br /> persons on site under CC&V supervision or contract. Distribution of this Plan is to be restricted to CC&V <br /> employees, contractors, and applicable government agencies/organizations.This Plan serves as the main SPCC <br /> plan for the CC&V at the Cresson Project Operations in the following areas: <br /> • Ironclad Facility and New Truck Shop(NITS) <br /> • Midway Fuel Farm (MFF); <br /> • Crusher Facilities; <br /> • Adsorption Desorption Recovery(ADR-1) Plant: <br /> • Process Solution Enhancement System (PSES) Facility; <br /> • High Grade Mill (HGM) Facility;and <br /> • Squaw Gulch Adsorption Desorption Recovery(ADR-2) Facility. <br /> • Mobile Service Equipment <br /> It is CC&V's policy to prevent releases to the environment of petroleum products and hazardous substances that <br /> may pose a threat to human health and/or the environment.Any releases that do occur and which are not in <br /> compliance with applicable Federal and State requirements expressed in site-specific permits or applicable <br /> regulations must be appropriately contained, remediated, recorded and reported. <br /> This Plan has been prepared to meet the requirements of Title 40,Code of Federal Regulations, Part 112 (40 CFR <br /> Part 112),and supersedes any earlier Plan developed to meet provisions in effect since 1974. <br /> CC&V Management has determined that this facility does not pose a risk for substantial harm under 40 CFR Part <br /> 112,as recorded in the"Substantial Harm Determination included in Section 2.3. <br /> This Plan has been prepared to meet the requirements of 40 Code of Federal Regulations(CFR ) Part 112(40 CFR <br /> Part 112)for CC&V's SPCC Plan and the requirements of the Colorado Division of Reclamation, Mining, and Safety <br /> (DRMS), and supersedes any earlier Plan developed to meet provisions in effect since 1974. <br /> In addition to this Plan,the SRP has been prepared in accordance with the requirements of 40 CFR Part 110,40 CFR <br /> Part 112,40 CFR Part 116,40 CFR Part 117,and 40 CFR Part 125.These references are on file with Sustainability <br /> and External Relations Department(S&ER).The scope of this SRP goes beyond the requirements of the SPCC <br /> regulations at 40 CFR Part 112 by not only addressing liquid petroleum products but also other hazardous <br /> substances that have been listed pursuant to the Clean Water Act(CWA)(§311(b)(2)) per 40 CFR Part 125(CWA <br /> hazardous substances subject to this SRP are listed in regulations in Table 116.4A(alphabetically)and Table 116.46 <br /> (by CAS number). Examples of listed substances are: Chlorine, Hydrochloric Acid, Hydrogen Cyanide, Nitrogen <br /> Dioxide,Sodium Cyanide, and Sulfuric Acid.)
