Reaept lonil: 92a422 <br /> f1t18/Zgg19 ®p4:47:03 PM Jean al rloo <br /> 2 4( 3 Rsc Fee:io.80 Doc Fee:9- GARFIELD COIdJTY CO <br /> opportunities;(3)public access to public lands; (4) a healthy environment and habitats for <br /> hunting and fishing; and(5) clean air and water;and <br /> WHEREAS,the Commission seek to ensure that gravel and mining extraction activities <br /> are regulated appropriately to promote responsible development and provide benefit to the <br /> general public, ensure that these activities mitigate their effects on the natural environment, <br /> including air quality,water quality,wildlife habitat, geothermal resources or important visual <br /> resources, and that the regulations in place for gravel and mining extraction protect the public <br /> health, safety and welfare of its citizens; and <br /> WHEREAS,the Commission desires that staff review the County Land Use and <br /> Development Code to consider gravel extraction and mining extraction activities throughout the <br /> County for planning,zoning, environmental impacts and public safety concerns associated with <br /> these uses; and <br /> WHEREAS,the Commission desires to impose a six (6)month moratorium to study <br /> these matters and develop policy and LUDC changes to better achieve the goals expressed in the <br /> Garfield County 2030 Comprehensive Plan and provide the County with effective tools to <br /> regulate these activities. <br /> NOW,THEREFORE,BE IT RESOLVED by the County Commissioners for Garfield <br /> County, Colorado, that: <br /> 1.Moratorium established.A temporary moratorium on the acceptance of applications for new <br /> permits and expansion of existing permits for the construction of gravel and mining extraction <br /> development in Garfield County shall be and is hereby established for a period of six(6)months <br /> from and after the adoption of this Resolution. <br /> 2.Purpose.The purpose of this Moratorium is to provide the Commission with proper tools to <br /> protect the public health, safety and welfare of the residents of Garfield County and to protect <br /> natural resources,and environmentally sensitive lands. <br /> 3.Develop appropriate policy and regulations. This temporary moratorium is established to <br /> allow sufficient time within which to complete the development of appropriate policy and <br /> regulations: (a)to promote the policies articulated in the Comprehensive Plan; (b)to develop <br /> suggestions and options to minimize any adverse visual effects or impacts of the development or <br /> expansion of gravel and mining extraction activities in the County;(c)to consider revisions and <br /> restrictions on gravel and mining uses in the County; (d)to consider imposition of use standards; <br /> (e)to consider the impact of gravel and mining extraction uses on environmentally sensitive <br /> areas and possible mitigation requirements; (fl to obtain such expert advice and assistance as <br /> necessary; (g)to consider such other matters as the Commissioners deem appropriate, <br /> 4.New applications.The Commission hereby declares a six(6) month moratorium on the <br /> acceptance of applications for new and expanded gravel and other mining development in <br /> Garfield County.For the period of six(6)months immediately following the effective date of <br /> this Resolution,the County, the Planning Commission,the Board of Adjustment, and the <br /> Community Development Department shall not permit,accept,process,interpret, deliberate <br /> 2 <br />
